Ordinance No. 57 ORDINANCE NO. 57 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, CALIFOR- NIA, AMENDING SECTION 13 . 01. 002 , "COMMISSION COMPOSITION AND MEMBERSHIP" AND SECTION 2 . 06. 060, "TERM" , EXPANDING THE PARKS AND RECREATION COMMISSION THROUGH THE ADDITION OF A STUDENT MEMBER WHEREAS, the City Council of the City of Chino Hills encourages broad based community involvement and participation in civic affairs; and WHEREAS, the City Council has created a Parks and Recreation Commission to work with the community and make recommendations for furthering leisure activities and recreational opportunities in Chino Hills; and WHEREAS, a vital and active element of the City is comprised of its children and young people; and WHEREAS, it would be beneficial to the efforts of the Parks "and Recreation Commission in the furtherance of leisure and recreational activities to have the regular and informed • participation of the City' s youth; THE CITY COUNCIL OF THE CITY OF CHINO HILLS DOES ORDAIN AS FOLLOWS: SECTION 1. Section 13 . 01. 002 , "Commission Composition and Membership" , of the Chino Hills Municipal Code is hereby amended to read as follows: 13 . 01. 002 Commission Composition and Membership. The Parks and Recreation Commission shall consist of five (5) Members appointed by the City Council pursuant to Section 2 . 06. 050 of this Code. The City Council shall serve as the Commission until such time as Commission is established and appointed. No officers or employees of the City or person under an employment contract subject to the jurisdiction of the City Council shall be Members of such Commission. There shall also be a non-voting ex officio Member of the Commission who shall be appointed by the School Board of the Chino Unified School District and shall be a resident of the City of Chino Hills. In addition, there shall also be a non-voting Student Member of the Commission appointed by the City Council who shall be a Chino Hills resident, attending high school in Chino Hills on a full time basis, with either junior or senior class ranking, and good academic standing. Section 2 . 06. 060, "Term" , of the Chino Hills Municipal Code is hereby amended to read as follows: • 2 . 06.060 Term. Commissioners and board members appointed pursuant to Section 2 . 06. 050 above, shall serve a term co- terminous with that of the individual City Council Member who nominated them. The Student Member as prescribed in Section 13 . 01. 002 of this Code, however, shall be nominated by the Mayor and confirmed by a majority vote of the City Council to serve a 12 month term from May of one year to May of the following year. Except as set forth below, no Commissioner shall serve a term exceeding four (4) years without being re-nominated and re- appointed. (a) Unless removed by a majority vote of the City Council, a Commissioner shall be entitled to serve on the Commission until a successor is appointed by the City Council. Upon the effective date of this Ordinance, the provisions thereof shall supersede any inconsistent or conflicting provisions of the San Bernardino County Code or other relevant non-codified San Bernardino County Ordinances as same were adopted by reference by City Ordinance Nos. 01-01 and 92-02 . • SECTION 4 . If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional . SECTION 5. The City Clerk shall certify as to the adoption of this Ordinance and shall cause a summary thereof to be published within fifteen (15) days of the adoption and shall post a certified copy of this Ordinance including the vote for and against the same in the Office of the City Clerk in accordance with Government Code Section 36933 . • -2- PASSED, APPROVED, AND ADOPTED this 14th day of June 1994 . • GARY .
