Ordinance No. 54 ORDINANCE NO. 54 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, CALIFORNIA, AMENDING SECTIONS 83 .030105, 84. 035(a) , AND 812 . 16135 OF THE SAN BERNARDINO COUNTY DEVELOPMENT CODE AS ADOPTED BY THE CITY OF CHINO HILLS RELATIVE TO GENERAL COMMERCIAL USES IN THE GENERAL COMMERCIAL DISTRICT THE CITY COUNCIL OF THE CITY OF CHINO HILLS DOES ORDAIN AS FOLLOWS: SECTION 1. Section 83 .030105(e) , "Conditional Use Permit Review Criteria, " of the San Bernardino County Development Code as adopted by the City of Chino Hills is hereby amended to read as follows: "83.030105 Conditional Use Permit Review Criteria. A Conditional Use Permit or alternate review procedure as allowed by this Section shall be required for the construction, alteration, or expansion of every use that is allowed by a land • use district subject to a Conditional Use Permit. • • • (e) Except as provided in Section 84. 0350 (a) , a Conditional Use Permit shall be required for all new development and for the expansion, alteration or any disturbance of land associated with an existing commercial, industrial, institutional, or multiple residential use, which involves at least five hundred (500) square feet and is greater than twenty-five percent (25%) of the ground area covered by the land use, or square footage of the original permitted structure. Cumulative expansions which meet these criteria also require a Conditional Use Permit. " SECTION 2 . Section 84. 0350(a) , "General Commercial (CG) District, " of the San Bernardino County Development Code as ----- adopted by the City of Chino Hills is hereby amended to read as follows: "84.0350 General Commercial (CG) District. The General Commercial (CG) District shall be located as specified by the San Bernardino County General Plan. • 7031121.2 11/16/93 III (a) PERMITTED LAND USES (1) Row, Field, Tree, and Nursery Crop Cultivation. (2) Any use authorized in the General Commercial Distrct in a Planned Development when a Preliminary Development Plan is obtained and a Final Development Plan is also required by this Code. (3) Accessory Uses as specified by Chapter 5 of this Division. " SECTION 3. Section 812. 16135, "Planned Development, " of the San Bernardino County Development Code as adopted by the City of Chino Hills is hereby amended to read as follows: "812.16135 Planned Development 'Planned Development' : A large, integrated development consisting of residential, commercial or industrial uses, or a mixture of such uses and associated ancillary uses and structures; that is situated on one (1) or more contiguous parcels or noncontiguous parcels separated solely by a road or other right-of-way or easement; and that is planned and • developed as a unified project within a single development operation or series of development operations in accordance with a detailed comprehensive development plan. The phrase 'Planned Development' shall also mean any 'Planned Unit Development' or 'PUD' which was approved by the County of San Bernardino prior to the enactment of Section 83 .030205 et seq. hereof. " SECTION 4 . Upon the effective date of this Ordinance, the provisions thereof shall supersede any inconsistent or conflicting provisions of the San Bernardino County Code or other relevant non-codified San Bernardino County Ordinances as the same were adopted by reference by City Ordinance Nos. 91-01 and 92-02 . SECTION 5. If any section, subsection, subdivision, sen- tence, clause, phrase, or portion of this Ordinance, is for any reasons held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivi- sion, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, • 7031121.2 -2- 11/16/93 • subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional . SECTION 6 . The City Clerk shall certify as to the adoption of this Ordinance and shall cause a summary thereof to be published within fifteen (15) days of the adoption and shall post a certified copy of this Ordinance, including the vote for and against the same, in the Office of the City Clerk, in accordance with Government Code Section 36933 .
