Wohlenberg Art Bennett Zai Abu Bakar Abe Hovsepian Jerrod Walters Karen Bristow Myrna Medina COMMISSIONERS ABSENT None The Planning Commission Meeting of September 19, 2006 was called to order at 7:00 p.m. by Chairman Bristow, who then led the audience in the Pledge of Allegiance. ITEM #4 - PUBLIC COMMENTS Pranav Patel, representing BAPS Development Inc., thanked City staff and Melissa Beeler for the superb assistance provided for the commencement ceremony held Saturday, September 16. There were about 1200 people in attendance. He also extended his appreciation to the Fire Department and the San Bernardino Sheriffs Department for their approval and participation. The blood drive netted about 80 pints of blood for the San Bernardino Blood Bank. He announced that on October 7, 2006, BAPS will be holding walk-a-thon at Chino Hills High School in conjunction with the American Cancer Society. ITEM #5 - CONSENT CALENDAR a. Minutes: September 5, 2006—Continued. Commissioner Bennett requested that his comments regarding his concerns about having a second Lowe's in Chino Hills be included in the minutes. Planning Commission Minutes—September 19, 2006 1 COMMISSION ACTION: The Planning Commission requested the minutes be presented for approval at the next meeting with appropriate corrections. MOTION: Bennett SECOND: Braun AYES: Eliason, Bristow, Hovsepian NOES: None ABSENT: None ABSTAIN: None b. Residential Design Review #306: 16412 Canon Lane (Tract No. 1945, Lots 5 and 6). A request by James Leung and Maria Provencher for approval of a Custom Home Design Review to construct a 3,847-square foot, four-story, single-family detached home. Staff recommendation: Adopt a resolution of approval. The Commission discussed the Condition of Approval related to existing and future right-of-way to make sure the conditions is enforceable as written. Assistant Director Abu Bakar and Assistant City Attorney Wohlenberg clarified the Condition. COMMISSION ACTION: The Planning Commission approved Item 5b. CASE NO: Major Variance 06MJV001 APPLICANT: Johnny & Peggie Withers PROPOSAL: A request for approval of Major Variance 06MJV001 to allow the construction of a swimming pool within the required 20- foot side yard setback located at 2395 Scenic Ridge Drive. The swimming pool will be located 5' 7" from the property line. LOCATION: 2395 Scenic Ridge Drive on the southeast corner of Scenic Ridge Drive and Fall View Court - Assessor's Parcel Number 1023-141-22. ;7 i Planning Commission Minutes—September 19, 2006 2 RECOMMENDATION: Staff recommends that the Planning Commission adopt the attached resolution approving Major Variance 06MJV001 • based on the findings of fact as listed in the attached Resolution and subject to the Conditions of Approval. Assistant Community Development Director Abu Bakar presented staffs report, which is on file with City's Community Development Department. Chairman Bristow opening the Public Hearing: Johnny R. Withers, 2395 Scenic Ridge Dr. Mr. Withers responded to Commissioner Hovsepian's question that the underground power line runs from the southwest corner of the property and is not near the swimming pool. Chairman Bristow closed the Public Hearing. COMMISSION ACTION: The Planning Commission approved Item 7a. Assistant Community Development Director Abu Bakar presented staffs report, which is on file with City's Community Development Department. ITEM #9 - COMMISSION INFORMATION a. City Council Unofficial Action Agenda of September 12, 2006. ITEM #10 - COMMISSIONER COMMENTS Commissioner Eliason said he attended the Candidate Forum and it was great. It makes a difference when people get out and vote. Chairman Bristow also attended the Candidate Forum and felt it was a good forum and that some of the questions were better this year. Planning Commission Minutes—September 19, 2006 3 Commissioner Bennett said that all Commissioners were required to attend mandatory Ethics i 1 training in December in accordance with AB 1234. City Attorney Wohlenberg reported that the League of Cities website details various methods for obtaining the training. The Commissioners agreed they would prefer to have the training locally rather than have to travel to Los Angeles. Assistant Community Development Director Abu Bakar indicated she would check on the dates of the training. Chairman Bristow announced that Friday, September 22 is Chino Hills Day at the fair.
