Chairman Bristow then led the audience in the Pledge of Allegiance. ITEM #4 - PUBLIC COMMENTS None ITEM #5 - CONSENT CALENDAR a. Minutes: July 18, 2006 b. Residential Design Review #317: 4201 Gird Ave. A request by Juan Nolasco to add 227-square feet of livable space consisting of a front and rear addition and a new 493- square foot garage to the existing 1,005-square foot single-story home. Staff recommendation: Adopt a resolution of approval. COMMISSION ACTION: The Planning Commission approved items 5a through 5b. Tract Home Design Review #318 and Minor Variance B35233: A request by Meritage Homes for approval of Tract Home Design Review #318 to construct 48 single-family detached homes on lots ranging from 7,200 square feet to 13,000 square feet located within Vesting Tentative Tract Map No. 15898. Meritage Homes is also requesting Planning Commission Minutes—August 15, 2006 1 I approval of Minor Variance B35233 to reduce the minimum aggregate twenty (20') side yard setback for Lots 50 and 97; to reduce the minimum two-foot (2') front yard variation i for adjacent structures for Lots 49 and 58; and to reduce the minimum twenty-foot (20') front yard setback for Lot 47. Commissioner Braun asked about lot coverage. City Planner Noh replied that all lot coverage standards have been met. Commissioner Hovsepian asked about affordable housing. Assistant Community Development Director/Development Services Abu Bakar replied that any residential final map approved prior to March 14, 2006 would not have to pay the in-lieu fee. Any residential final map approvals after March 14, 2006 must pay in lieu fee. COMMISSION ACTION: The Planning Commission approved a Resolution approving Tract Home Design Review #318 and Minor Variance B35233 based on the findings of fact, the site plan, floor plans, elevations and color/material boards, and subject to Conditions of Approval. CASE NO: Major Variance 06MJV004 APPLICANT: William & Heidi Walls PROPOSAL: A request for approval of Major Variance 06MJV004 to allow the pool and spa equipment to be located two (2)feet from the real property line. LOCATION: 15638 Outrigger Drive A.P.N.s: 1028-591-07 RECOMMENDATION: Staff recommends that the Planning Commission adopt a resolution approving Major Variance 06MJV004, based on the findings of facts as listed in the resolution. Mr. Walls thanked staff for working with him. CASE NO: Major Variance 06MJV005 APPLICANT: Country Club Villas, Inc. PROPOSAL: A request for approval of an Extension of Time 06EXT01 for Site Plan Review 03SPRO3 and Major Variance 06MJV005 LOCATION: The site is located on the east side of Pomona Rincon Road and the terminus of Los Serranos Boulevard, adjacent to the west side of SR-71. A.P.N.: 1028-181-05, 06, 07 and 08 RECOMMENDATION: Staff recommends that the Planning Commission adopt the attached resolution approving Extension of Time 06EXT01 for Site Plan Review 03SPR03 and Major Variance 06MJV005, based on the findings of facts as listed in the resolution. Commissioner Bennett was concerned with the proximity of the construction equipment and the safety of the students. He asked if construction could be limited to when school is in session. Assistant Community Development Director/Building Services Ward replied that the area is pretty flat and no grading will be taking place. It is also difficult to try to tie the construction to school hours. Developers must adhere to mandated construction hours. George Butler, resident from Bird Farm Road, said there would be signs advising parents where to drop off students. Teachers will be watching to make sure students cross the street at designated crosswalks. COMMISSION ACTION: The Planning Commission approved a Resolution approving Extension of Time 06EXT01 for Site Plan Review 03SPR03 and Major Variance 06MJV005, based on the findings of facts as listed in the resolution. CASE NO: Environmental Impact Report SCH #20060210140, General Plan Amendment 06GPA01, Zone Change 06ZC01, Specific Plan 06-01, Development Agreement 06-02, Tentative Parcel Map No. 18236, Site Plan Review 06SPR02 and Associated Site Program. APPLICANT: Opus West Corporation PROPOSAL: The Applicant is proposing to develop an office/retail/hotel project. The proposed development includes a home improvement tenant, various major retail tenants, in-line shops, fast food/restaurant tenants, a bank and a three-story office/hotel building. The total proposed building area is approximately 500,000 square feet. The project site is approximately 49.1 acres. Planning Commission Minutes—August 15, 2006 3 LOCATION: Southeast corner of Chino Hills Parkway and Ramona Ave. RECOMMENDATION: Staff recommends that the Planning Commission continue the Commons project to September 5, 2006 Public Comments: Francisco Bernal, Monte Vista Mobile Park. Mr. Bernal said many of the residents were concerned that the mobile park may be sold. Chairman Bristow said his concern was valid. The property is private and the owner can sell if they choose. She encouraged Mr. Bernal to speak to the property owner. Assistant City Attorney Wohlenberg said there is protection for mobile home park residents and that selling mobile parks is often difficult. COMMISSION ACTION: The Planning Commission agreed to continue the Commons project to September 5, 2006. ITEM #10 - COMMISSIONER COMMENTS Commissioner Hovsepian said the Healthy Cities Committee recently met. The poster contest is underway and judging will take place in a couple of weeks. Chino Hills Day at the Fair will be September 22. Commissioner Hovsepian will not be at the September 5th meeting.
