08-13-2019 CC Rpt 31COUNCIL AGENDA STAFF REPORTCOUNCIL AGENDA STAFF REPORT TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS DATE: AUGUST 13, 2019 FROM: CITY MANAGER ITEM NO:31 SUBJECT:PARKS AND RECREATION COMMISSION MEMBER APPOINTMENT RECOMMENDATION: Appoint one member to the Parks and Recreation Commission to fill the unexpired term of William (Bill) Taylor through November 30, 2020. BACKGROUND/ANALYSIS: Parks and Recreation Commissioner William (Bill) Taylor submitted a letter of resignation from the Parks and Recreation Commission effective July 24, 2019. A Notice of Vacancy was posted for the unscheduled vacancy on July 24, 2019, in accordance with Government Code Section 54729 (Maddy Act). Commission and Committee members appointed pursuant to Chino Hills Municipal Code (CHMC) Section 2.28.050 serve terms coterminous with that of the individual City Council member who nominated them. Mr. Taylor's term was coterminous with the term of Mayor Cynthia Moran. ENVIRONMENTAL (CEQA) REVIEW: This action is not a project within the meaning of the California Environmental Quality Act (CEQA) Guidelines Section 15278 and is therefore exempt from CEQA as it is an administrative change that will not result in any direct or indirect physical change in the environment. B. 2.28.030 - Qualifications. Unless otherwise specifically provided by law, or by ordinance or resolution of the City Council, all members of boards and commissions of the city shall, at all times during their incumbencies, be bona fide residents and registered voters of the city. No member of any board or commission shall be a city employee, nor shall any person be a member of more than one board or commission at any one time. (Ord. 91-05 § 2.06.030) 2.28.040 - Applications. The City Clerk shall maintain all applications submitted to the city for board or commission positions for a period of two years. (Ord. 91-05 § 2.06.040) 2.28.050 - Appointment. Members of each board and commission shall be appointed, and may be removed, by a majority of the City Council. The chairperson of the board or commission shall be appointed by a majority vote of the City Council. (Ord. 91-05 § 2.06.050) 2.28.060 - Term. Commissioners and board members appointed pursuant to Section 2.28.050 of this section, shall serve a term coterminous with that of the individual City Council member who nominated them. The student member as prescribed in Section 2.32.020 of this code, however, shall be nominated by the Mayor and confirmed by a majority vote of the City Council to serve a twelve (12) month term from May of one year to May of the following year. Except as set forth in this section, no Commissioner shall serve a term exceeding four years without being renominated and reappointed. Unless removed by a majority vote of the City Council, a Commissioner shall be entitled to serve on the Commission until a successor is appointed by the City Council. Can you please confirm that this email will suffice to effectuate my immediate resignation so Cynthia can begin the process of recruiting and selecting a replacement. I do not plan on attending any additional Parks and Recreation Commission meetings. It has been an absolute honor to have served our City under you leadership as your Commissioner! I look forward to continuing to volunteer and serve our City and Community on the Foundation, with the Parade, and in other ways. I will also text you this message. I would like to let my follow Commissioners, Jonathan, and others know as soon as possible, but only after you acknowledge receipt of this note. In the meantime, I am letting Commission Chair Greg Higgins know I will not be able to attend tonight’s Commission Meeting because I have a work conflict. 498/658 Cynthia, I am very grateful for all the support you have given to me during my time on the Commission, and look forward to continuing our work together with all the other Superstars in this town...
