A2019- 047 FOR THE LOWER LOS SERRANOS STREET LIGHT IMPROVEMENT PROJECT (CIP S16006) RECOMMENDATION: Make a Finding of Necessity for Barnes Electric Contract No. A2019-047 for the Lower Los Serranos Street Light Improvement project (CIP S16006), allowing the addition of Superior Paving Company, Inc., dba United Paving Co. as a paving subcontractor. BACKGROUND/ANALYSIS: On February 26, 2019, the City Council awarded a construction contract to Barnes Electric for the installation of 13 street lights in the Los Serranos area; specifically Monterey Avenue, Mesa Boulevard, and Brookview Court, in the amount of $129,470.01. The Notice of Award was issued to the contractor on March 5, 2019, and the Notice to Proceed was issued on March 25, 2019. The bid documents for this project did not include any reference to subcontractors being utilized in the completion of the improvements required with this project. However, the pavement repair proposed for the contractor's work included a wider than originally anticipated pavement width, and Barnes Electric became uncertain of their ability to perform these pavement repairs to the standards required with the plans and specifications. On July 31, 2019, staff received a written request from Mr. Barnes, the owner of Barnes Electric, to allow him to add a paving subcontractor to this project who specializes in and is more proficient at making these repairs to the City's standards. This letter has been included as an attachment to this report. Pursuant to Public Contract Code §4109, "Subletting or subcontracting of any portion of the work in excess of one-half of 1 percent of the prime contractor's total bid as to which no subcontractor was designated in the original bid shall only be permitted in cases of public emergency or necessity, and then only after a finding reduced to writing as a public record of the awarding authority setting forth the facts constituting the emergency or necessity". By making a Finding of Necessity for Barnes Electric, the requirements of Pubic Contract Code §4109, as it relates to the aforementioned finding of necessity, will have been satisfied. 488/658 ENVIRONMENTAL (CEQA) REVIEW: City staff has determined that the project is exempt as a Class 2 Categorical Exemption, (existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities), pursuant to Section 15302 of Guidelines for the California Environmental Quality Act of 1970, as amended, Public Resources Code section 21000 et seq. FISCAL IMPACT: The current Capital Improvement Program has $298,800 budgeted for the Lower Los Serranos Street Light Improvement project. There is no anticipated impact on the General Fund, nor change to the contract cost with this item. REVIEWED BY OTHERS: This item has been reviewed by the Finance Director and the City Attorney. I am prepared to sign a contract with them for $22,000.00 to pay for this additional paving. The width of paving has increased beyond what I am comfortable doing myself, and I would like to use United Paving Co. to complete the repairs for me. This will ensure a better end product for the City and will result in fewer pavement failures in the years to come.
