BACKGROUND/ANALYSIS: Pursuant to Chino Hills Municipal Code Chapter 10.32 Wheeled Toys, City Council may designate by resolution prohibitions against the use of rollerblades, skateboards, rollerskates, or similar activity on any public or private property. Staff recommends that the Government Center be designated as a No Wheeled Toy Zone. The Government Center includes facilities for the Chino Hills City Hall, Chino Hills Police Department, Chino Valley Fire Department, James S. Thalman Branch Library, and the Government Center Parking structure. This resolution is proposed because rollerblading, skateboarding, and roller-skating activities create a public nuisance and hazard in areas where high volumes of pedestrian and vehicular traffic exists. Skateboarders at the old city hall created unsafe conditions by skateboarding in the parking area, traffic lanes and on sidewalks. In addition, these types of activities have caused damage to public property such as the picnic tables, trashcans, and other structures. Skateboarding has been observed by staff at the government center parking structure where skateboarders are using the ramps to travel from the top of the structure to the bottom. The danger to skateboarders is expected to intensify as government center traffic increases from holiday shoppers and the opening of the Library in early 2009. Violations are deemed a General Penalty infraction (Section 1.36.020) and are punishable by a fine of not more than $100 for a first offence. This action is designed to prohibit recreational wheeled toy use on the Government Center properties, not to discourage the use of wheeled toys for transportation to the site. WHEREAS, Section 10.32.040 of the Chino Hills Municipal Code authorizes the City Council to designate any public property, owned or maintained by the City as a No Wheeled Toy Zone; and WHEREAS, the City recommends the Government Center facilities, including the Chino Hills City Hall, Chino Hills Police Department, James S. Thalman Chino Hills Branch Library, Chino Valley Fire District, and Chino Hills Government Center Parking Structure and surface parking lots, be designated a "No Wheeled Toy Zone." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHINO HILLS DOES RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. In accordance with Chapter 10.32 of the Chino Hills Municipal Code, roller skating, skateboarding, rollerblading, and similar activities involving similar wheeled toys are hereby prohibited at the Chino Hills Government Center facilities, including the Chino Hills City Hall, Chino Hills Police Department, James S. Thalman Chino Hills Branch Library, Chino Valley Fire District, and Chino Hills Government Center Parking Structure and surface parking lots. SECTION 2. The Public Facilities and Operations Department is hereby directed to post appropriate signage of these restrictions against wheeled toys in accordance with Chino Hills Municipal Code Section 10.32.050. SECTION 3. Any violation of this chapter is deemed an infraction, punishable as provided in Section 1.36.020 of this code. Subsequent violations shall also be punished as provided in Section 1.36.020 of this code. SECTION 4.
