A07-103 WITH RJM DESIGN GROUP, INC. FOR ITEMS RELATED TO THE PARK CONSTRUCTION ENHANCEMENT PROGRAM RECOMMENDATION: Approve Amendment No. 4 to Agreement No. A07-103 with RJM Design Group, Inc. for a net credit in the amount of $94,855.39 bringing the revised compensation to a not -to -exceed amount of $531,844.61. 2. Approve an appropriations transfer in the amount of $35,000 (remaining landscape & lighting district fund and general fund only) from the Torrey Pines Park Modifications project to the Mystic Canyon Building Replacement project. BACKGROUND/ANALYSIS: On July 22, 2008, the City Council approved Amendment No. 3 to agreement No. A07-103 with RJM Design Group, Inc. (RJM) to develop construction drawings and related documents for both the Mystic Canyon Recreation Building Replacement and the Torrey Pines Park Modifications projects. As work progressed on the design, RJM requested updated geotechnical analysis of the site with recommendations consistent with current building codes. The City's Geotechnical Consultant, GMU, reviewed existing geotechnicai reports and found the following: The Torrey Pines Park site sits on a fault zone. The established seismic setback precludes construction of a habitable structure as defined by the Alquist-Prioio Earthquake Fault Zoning Act. Although the Act includes provision for a waiver, such a request must include data showing that no hazard exists, and must be approved by both the City and the State Geologist. Given that a structural setback has already been established based on data collected for the tract development (i.e., there is an active fault within the setback zone), it appears the waiver is not a viable option. Accordingly, staff directed the Consultant to stop work on the building design. The reduced scope resulted in a credit of $115,655.39. 2. Mystic Canyon Park requires supplemental geotechnicai investigation to evaluate previously undocumented fill in the area. The cost for this investigation is $14,000, which was not included in the current appropriation for that project. AGENDA DATE: December 9, 2008 Page 2 SUBJECT: AMENDMENT NO, 4 TO AGREEMENT NO. The available topographic data was insufficient to establish a base map for the planned construction. RJM provided aerial mapping and topographic base at a cost of $5,800. Staff also recommends an additional allowance of $15,000 for reimbursable expenses related to this project. REVIEW BY OTHERS: This agenda item has been reviewed by the Finance Director and the City Engineer. FISCAL IMPACT: An appropriations transfer from the Torrey Pines Park Modifications project to the Mystic Canyon Building Replacement project in the amount of $35,000 in necessary to fund this work. A07-103 WITH RJM DESIGN GROUP, INC. FOR LANDSCAPE ARCHITECTURAL DESIGN SERVICES THIS AMENDMENT NO. 4 TO AGREEMENT NO. A07-103, with RJM Design Group, Inc., dated December 9, 2008, is entered into in the State of California by and between the City of Chino Hills, a California general law municipal corporation, hereinafter called "City" and Strategic Connections, Inc., hereinafter called "Consultant'. It is hereby agreed to be amended as follows: Amend Scope of Services related to the Torrey Pines Park Improvements to reflect actual cost of services performed through November 18, 2008. Total compensation for services to date related to the Torrey Pines Park Improvement is reduced from $194,500 to $78, 844.61. Amend Scope of Services related to the Mystic Canyon Building project to include: • additional services for aerial mapping and topographic base at a cost of $5,800; • a reimbursable allowance of not -to exceed $15,000 Total compensation for services related to Mystic Canyon Building project is increased from 174,500 to $195,300. Original Agreement $ 163,200.00 Amendment No. 1-3 $ 463,500.00 Amendment No. 4 ($ 94.855,39) Total $ 531,844.61 All other provisions of said Agreement shall remain unchanged and in effect. IN WITNESS WHEREOF, the City Council of the City of Chino Hills has caused this Amendment to the Agreement to be subscribed by its duly authorized officers, in its behalf, and the said party of the second part has signed this Agreement.
