The proposal includes the installation of three (3) new 6-foot tall dual 700MHz antennas, and three (3) new 700MHz remote radio heads (RRUS11B12) attached to the existing SCE lattice tower for a total of nine (9) antennas. The proposal also includes the replacement of one (1) DUL20 digital base band unit with one (1) DUS41 unit installed behind the antennas. On November 4, 2003, an extension of time was granted for Site Development Permit 02SDP08 for one (1) year to allow both wireless carriers additional time to obtain proper easements and acquire building permits. Conditions of Approval No. 1 for Site Development Permit 02SDP08 required the Site Development Permit to be used within one (1) year of the approval or a new Site Development Permit application would be required. Verizon Wireless complied with all conditions of approval within the one (1) year time frame as well as finalized their City of Chino Hills 2 of 7 July 22, 2015 Site Development Permit 15SDt - T-Mobile Wireless Communications Facility Modification communications license agreement with the City on January 11, 2005 (License Agreement A05-02). On the other hand, Cingular entered into an agreement with the City on July 8, 2003 (License Agreement A03-96), but they failed to receive their building permit final for the construction of their wireless facility and proceeded with operating the facility. On January 5, 2005, Cingular informed the City that the ownership of the wireless facility was conveyed to T-Mobile. In 2014, T-Mobile contacted the City to inquire about modifying their existing facility and staff determined that a new Site Development Permit entitlement would be required for T-Mobile only, given that the original entitled Site Development Permit involved two (2) separate wireless carriers and only Verizon had demonstrated compliance whereas Cingular (now T-Mobile) did not. On January 28, 2015, T-Mobile submitted a new Site Development Permit (15SDP01) application to modify and upgrade the existing wireless communications facility to improve wireless coverage and services in the vicinity (Exhibit "B"). The Project Review Committee (PRC) reviewed and recommends approval of the modifications of the T-Mobile wireless communications facility. Vicinity Map PROPOSAL The applicant is requesting the approval to modify an existing T-Mobile wireless communications facility located at 6090 Pine Avenue (Exhibit "B"). The proposal includes City of Chino Hills 3 of 7 July 22, 2015 Site Development Permit 15SD1 ., T-Mobile Wireless Communications Facility Modification slight relocation and adjustment of six (6) existing 4-foot antennas, the installation of three (3) new 6-foot tall dual 700MHz antennas mounted to an expanded cross arm, and three (3) new 700MHz remote radio heads (RRUS111312) mounted to expanded cross arms and attached to an existing SCE lattice tower totaling nine (9) antennas (12 maximum from original approval). The proposal also includes the replacement of one (1) DUL20 digital base band unit with one (1) DUS41 unit installed behind the antennas. The existing above ground equipment cabinet within T-Mobile's existing above -ground equipment lease area will not change. The new and existing antennas and the new remote radio heads will be painted to match the exterior the lattice tower (Condition of Approval No. 8). APPROVAL REOUIRED Chapter 16.44 of the Chino Hills Development Code requires approval of a Site Development Permit to construct a wireless facility. The applicant is seeking approval from the City for the following: • A Site Development Permit to modify an existing T-Mobile wireless communications facility located on City property at 6090 Pine Avenue. ANALYSIS GENERAL PLAN AND ZONING CONSISTENCY The project site is identified as Public Open Space on the General Plan Land Use Map and is Zoned PD 50-167 (Open Space). Chapter 16.44 of the Development Code designates a utility mounted wireless facility as a "minor facility", which requires approval of a Site Development Permit. If the Site Development Permit is approved, the proposed upgrade and modification would be consistent with the Development Code, a tool used to implement the General Plan. Therefore, the approval of Site Development Permit 15SDP01would be consistent with the General Plan. DEVELOPMENT STANDARDS Buildina Heiaht Chapter 16.44 of the Chino Hills Development Code states that no minor facility shall exceed the maximum building height for the applicable zoning district. The PD 50-167 (Open Space) zoning district does not specify a maximum building height within the Chino Hills Development Code. The existing SCE lattice tower is one hundred and forty-three feet (143') tall, and the proposed replacement panel antennas will be installed on the tower at approximately forty-eight feet and eight inches (48' 8") above grade, which is the original height previously approved for Site Development Permit 02SDP08. Buildina Setback The PD 50-167 (Open Space) zoning district does not have setback standards. The proposed modification will not relocate the position of the existing SCE lattice tower or the above -ground equipment shelter. T-Mobile Wireless Communications Facility Modification Antenna and Eauinment Screeninq The new panel antennas and remote radio heads will be painted to match the exterior of the SCE lattice tower (Condition of Approval No. 8). The ground mounted equipment is screened within a 160-square foot equipment shelter. Therefore, the proposed modifications to the existing wireless facility satisfy the screening requirement of the Development Code. FISCAL IMPACT Pursuant to the existing License Agreement (A03-96), the City receives lease payments from the applicant for the use of the City's property in connection with the operation of this facility. The proposed modification will not affect the financial benefit received by the City for the lease of this property. ENVIRONMENTAL ASSESSMENT Staff has determined that the proposed project is categorically exempt from the California Environmental Quality Act pursuant to Section 15301(e) Existing Facilities of the California Environmental Quality Act Guidelines. The Site Development Permit is to allow the upgrade and modification of an existing wireless communications facility; the modifications consist of attaching three (3) new panel antennas to an existing, three (3) new remote radio heads and the replacement of existing equipment in its current location. Therefore, staff has determined with certainty that the project does not have the potential to cause a negative impact on the environment. FINDINGS Pursuant to Section 16.78.040 of the Development Code, the following Findings shall be made in the affirmative for Site Development Permit approval: A. FINDING: That the requested Site Development Permit will not adversely affect the purpose and intent of Chapter 16.78 Site Development Permits and the proposed use is consistent with the City of Chino Hills General Plan. FACT: The proposed project does not adversely affect the purpose and intent of Chapter 16.78. The project site is identified as Public Open Space on the General Plan Land Use Map and is zoned Planned Development PD 50-167 (Open Space). The upgrade and modification of a facility at an existing location is subject to the approval of a Site Development Permit. If the Site Development Permit is approved, the proposed upgrade and modification would be consistent with the Development Code, a tool used to implement the General Plan. Therefore, the approval of Site Development Permit 15SDP01 would be consistent with the General Plan. B. FINDING: That the proposed use is consistent with the provisions of the Development Code for the City. City of Chino Hills 5 of 7 July 22, 2015 Site Development Permit 15SD� ., T-Mobile Wireless Communications Facility Modification FACT: The proposed project is consistent with the provisions of the City's Development Code in that Chapter 16.44 of the Development Code designates a utility mounted wireless facility as a minor facility which requires approval of a Site Development Permit. Further, the project shall comply with all applicable development standards for wireless communications facilities. The proposed upgrade will be attached to the same existing SCE tower and in the same general location. As required for minor facilities within public open space, the antennas will be attached to the existing SCE tower and will not increase the height of the existing structure. The antennas will also be painted to match the tower. C. FINDING: That the proposed use will not have significant adverse effects on adjoining land uses and other permitted uses of the area in which it is proposed to be located. FACT: The nature, condition, and development of adjacent uses, buildings and structures have been considered and the proposed development and use will not adversely affect or be materially detrimental to these adjacent uses, buildings or structures in that the proposed upgrades and modifications will not be noticeably different from what currently exists on -site and therefore, there should be no perceptible difference from the adjacent buildings, structures, and properties. The new antennas and remote radio heads will be painted to match the exterior of the existing tower. The replacement cabinets are within an existing equipment enclosure and will not impact visual character. The project is not anticipated to cause significant adverse effects to adjoining land uses. D. FINDING: That the approval of the Site Development Permit application is in compliance with the requirements of the California Environmental Quality Act (CEQA). FACT: In accordance Section 15301(e) Existing Facilities of the California Environmental Quality Act (CEQA) Guidelines, the proposed project is categorically exempt from CEQA. The Site Development Permit is to allow the upgrade and modification of an existing wireless communications facility, which will consist of attaching new antennas to an existing structure and the replacement of existing equipment in its current location. Therefore, staff has determined with certainty that the project does not have the potential to cause a negative impact on the environment. E. FINDING: That the application will not result in conditions or circumstances contrary to the public health, safety and general welfare of the City. FACT: Compliance with the Building Code, Development Code, and the project Conditions of Approval ensures that the project will not result in conditions or circumstances contrary to the public health, safety and general welfare of the City. The nature, condition, and development of the project will comply with City regulations in regards to hazardous materials, noise, odors and other nuisances.
