The Site Development Permit amendment was recently approved by the Community Development Director. Staff recommends that you now indicate your approval of this project by signing below. Once you have approved the project, Exhibit C in Attachment 1 will replace the existing Exhibit C in Agreement A00-139 with T-Mobile. The proposed modification consists of the removal of three (3) (56" H x 12" W x 7.5" D) existing Air21 panel antennas (one antenna per sector mounted on the existing reservoir) and replace with three (3) (96" H x 12.1" W x 8.7" D) new Air21 panel antennas (one antenna per sector mounted on the existing reservoir). The approval allowed the installation of six (6) panel antennas (two antennas per sector for a total of three sectors) to the exterior of the reservoir. The dimensions of each panel antenna is 59" H x 8" W x 2.7" D. The approval also included a 126-square foot (6'-0" x 21'-0") equipment lease area for two (2) above -ground equipment cabinets and supporting cables and utilities (i.e. telco pedestal, electrical panel, and a microwave dish). The equipment lease area is enclosed by a six-foot (6'-0") tall galvanized chain link fence and screened by existing landscaping that surrounds the reservoir. Subsequent to the approval and construction of the Pacific Bell Wireless communications facility, the ownership of the facility was conveyed to T-Mobile. On May 30, 2013, the Community Development Director approved an amendment to remove existing antennas and tower mounted amplifiers (TMA's) and the install six (6) new panel antennas, three (3) twin TMA's, and three (3) HCS hybrid antenna cables attached to the exterior of the reservoir using the existing antenna sectors. The modification also included an internal cabinet upgrade to one (1) existing 3106 RBS cabinet within T-Mobile's existing above- ground equipment lease area, with the new panel antennas, twin tower mounted amplifiers, and the HCS hybrid antenna cables painted to match the color of the existing reservoir and the ground mounted equipment screened from public view by an existing fence and mature landscaping. On November 19, 2014, Reliant Land Services, Inc., the representative for T-Mobile, submitted an application for a second amendment to Site Development Permit 00SDP01 to allow the modification of the existing facility to improve wireless communications signal strength and data capacity. The modifications do not result in an increase in the number of antennas beyond the approval of the original entitlement. The project also includes the addition of three (3) more Remote Radio Units (RRUs) (one RRU per sector mounted on the existing reservoir). Some of the supporting equipment within the existing equipment lease area will also be upgraded to support the new antenna installation. The new panel antennas and RRUs will be painted to match the color of the existing reservoir. ANALYSIS GENERAL PLAN AND ZONING CONSISTENCY The project site is identified as Institutional on the General Plan Land Use Map and is zoned PD 17-127 (Reservoir). Chapter 16.44 of the Chino Hills Development Code designates a wireless facility that is collocated on an existing utility structure as a "minor facility", which requires the approval of a Site Development Permit when located in a nonresidential zoning district. The proposed modifications will add trees to screen the increase in antenna length from 56 inches to 96 inches so as to not adversely alter the existing appearance of the facility and will improve T-Mobile's wireless coverage and services in the vicinity of the Miramonte Court Reservoir. If the second amendment to the Site Development Permit is approved, the proposed modification would be consistent with the Development Code, a tool used to implement the General Plan. Approval of the proposed amendment furthers Goal LU-2: Balance Residential with Commercial, Business, and Public Land Uses, and Goal S-3: Achieve Adequate Emergency Service. In providing T-Moblle the opportunity to better serve their customers in Chino Hills, the City furthers its goals of balancing land uses and providing emergency service. Therefore, the approval of the second amendment to Site Development Permit 00SDP01, subject to the attached Conditions of Approval, is consistent with the General Plan. DEVELOPMENT STANDARDS Building Height Chapter 16.44 of the Chino Hills Development Code states that no minor facility shall exceed the maximum building height for the applicable zoning district. PD 17-127 does not specify a maximum building height for the reservoir site, but the Development Code specifies a maximum building height of forty (40) feet for a structure located in the Institutional - Public (I-2) zoning district. The existing Miramonte Court Reservoir has an existing roofline of thirty-two feet (32'-0"). The proposed antennas will be installed at thirty one feet (31'-0") above ground level and will not exceed the existing roofline of the reservoir. Therefore, the proposed project meets the required height regulation for a minor facility as well as comply with the maximum building height standard for a structure located in the Institutional - Public (I-2) zone. Antenna and Eaulament Screening The new panel antennas, RRUs and ancillary equipment will be painted to match the color of the existing reservoir. The top of the antennas will be below the maximum height of the reservoir and will not project above the existing roofline. However, the new antennas will increase in length from 56 inches to 96 inches and have the potential to create additional aesthetic concerns from the surrounding neighborhood. Therefore, the proposed modifications to the existing wireless facility will not alter the existing appearance of the facility and satisfy the screening requirement of the Development Code. Buildina Setback The Development Code does not specify building setback requirements for a minor wireless facility, but only specifies height requirements. Therefore, building setbacks are not applicable to the proposed project. Parkina. Traffic and Access The proposed minor wireless facility Is an unmanned facility and will be remotely monitored by T-Mobile; minimal maintenance is required. As the City's reservoirs are considered to be secured facilities, any T-Mobile personnel, or contractors working on T- Mobile's behalf, are required to be escorted by City personnel at all times when they are present at the reservoir pursuant to the existing License Agreement A00-139 and Amendment No. 1, which contains the City's current access restrictions and requirements, including the provision of a security deposit. Therefore, the proposed project will not impact existing parking, traffic, or access to the reservoir or surrounding properties. FISCAL IMPACT Pursuant to the existing License Agreement (A00-139) and Amendment No. 1, the City receives lease payments from the applicant for the use of the City's property in connection with the operation of this facility. The proposed modifications will not affect the financial benefit received by the City for the lease of this property. ENVIRONMENTAL ASSESSMENT Staff reviewed the Project's environmental impacts under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., "CEQA") and the regulations promulgated thereunder (14 California Code of Regulations §§ 15000, et seq., the "CEQA Guidelines") and determined that the project is exempt from CEQA review pursuant to Sections 15301 and 15302 of the CEQA Guidelines. The second amendment to Site Development Permit 00SDP01 is to allow the modification of an existing wireless communications facility; the modifications consist of attaching new antennas and associated equipment to an existing reservoir, which will not exceed the height of the existing roofline of the reservoir. The proposed modifications will also upgrade an existing equipment cabinet in its current location. Therefore, staff has determined with certainty that the project does not have the potential to cause a negative impact on the environment and is exempt from CEQA. FINDING: That the requested Site Development Permit will not adversely affect the purpose and intent of Chapter 16.78 Site Development Permits and the proposed use is consistent with the City of Chino Hills General Plan. FACT: The proposed project does not adversely affect the purpose and intent of Chapter 16.78. The project site is designated as Institutional in the General Plan Land Use Map and is zoned PD 17-127 (Reservoir), which allows wireless communication facilities. The proposed project is consistent with the General Plan in that the Development Code, a tool that is used to implement the General Plan, stipulates that the construction of a minor facility for wireless communications requires the approval of a Site Development Permit as it has relatively low potential for adverse impacts to the site and the surrounding uses. Approval of the proposed amendment furthers Goal LU-2: Balance Residential with Commercial, Business, and Public Land Uses, and Goal S-3: Achieve Adequate Emergency Service. Therefore, the approval of the second amendment to Site Development Permit 00SDP01, subject to the attached Conditions of Approval, is consistent with the General Plan. B. FINDING: That the proposed use is consistent with the provisions of the Development Code for the city. FACT: The proposed project is consistent with the provisions of the City's Development Code in that the Development Code requires a Site Development Permit to be approved for the construction of a minor wireless communications facility in a nonresidential zoning district. Further, the project shall comply with all applicable development standards for the PD 17-127 (Reservoir) zoning district and the development standards of Chapter 16.44 Wireless Communications Facilities. C. FINDING: That the proposed use will not have significant adverse effects on adjoining land uses and other permitted uses of the area in which it is proposed to be located. FACT: The nature, condition and development of adjacent uses, buildings and structures have been considered and the proposed development and use will not adversely affect or be materially detrimental to these adjacent uses, buildings or structures in that the proposed project is designed to be compatible with the existing development with regards to site planning and exterior design. The new antennas, TMA's, and HCS hybrid antenna cables will be painted to match the exterior of the reservoir while the ground mounted equipment will remain in its existing location within T-Moblle's lease area located on the south side of the reservoir. The attachment of the antennas to the reservoir and the location of the associated equipment are in a location that is screened from public view by topography and vegetation, which prevents any significant visual impact to the surrounding uses. The project is not anticipated to cause significant adverse effects to adjoining land uses. D. FINDING: That the approval of the Site Development Permit application is in compliance with the requirements of the California Environmental Quality Act (CEQA). FACT: In accordance with Sections 15301 Existing Facilities and 15302 Replacement or Reconstruction of the CEQA Guidelines, the proposed project is categorically exempt from CEQA. The second amendment to Site Development Permit 00SDP01 is to allow the modification of an existing wireless communications facility; the modifications consist of attaching new antennas and associated equipment to an existing reservoir, which will not exceed the height of the existing roofline of the reservoir. The proposed modification will also upgrade an existing equipment cabinet in its current location. Therefore, staff has determined with certainty that the project does not have the potential to cause a negative impact on the environment and is exempt from CEQA. E. FINDING: That the application will not result in conditions or circumstances contrary to the public health, safety and general welfare of the city. FACT: Compliance with the Building Code, Development Code, and the project Conditions of Approval ensures that the project will not result in conditions or circumstances contrary to the public health, safety and general welfare of the City. The nature, condition, and development of the project will comply with City regulations in regards to hazardous materials, noise, odors and other nuisances. RECOMMENDATION The Project Review Committee has reviewed the project and recommends the approval of the project subject to the attached Conditions of Approval. Therefore, staff recommends that the Community Development Director approve the second amendment to Site Development Permit 00SDP01 based on the Findings of Fact contained herein and subject to the Conditions of Approval. This second amendment to the Site Development Permit (00SDP01) shall become null and void if all conditions of approval have not been complied with and the Permit is not used within three (3) years of the date of approval. The Community Development Director may grant one extension of time for a period not to exceed one (1) year, provided an application requesting the extension is filed with the Planning Division no Tess than 30 days prior to the expiration of the Permit. "Used" as referred to in this Condition means the commencement of substantial construction activity or any activity authorized by the approval. If an extension of time is not granted, the SDP shall expire and a new application shall be required. 2. In addition to the City's right to revoke or revise this Site Development Permit for violation of any of the conditions herein, pursuant to Section 16.78.090 and 16.44.110 of the Chino Hills Development Code, the City, its Planning Commission and its City Council retain and reserve the rights and jurisdiction to review and modify all Site Development Permits approved by the City, including the conditions of approval, based on changed circumstances. Changed circumstances include, but are not limited to, the following in relation to the approved facility as described and diagrammed in the related Site Plan: increased height or size of the facility; additional impairment of the viewshed from surrounding properties; change in the type of antenna or support structure; change of color and materials; substantial change in location on the site; and an effective increase in signal output above Maximum Permissible Exposure (MPE) limits imposed by the Revised Radio Frequency Emission Guidelines by the Federal Communications Commission. 3. The wireless facility shall be maintained in good condition at all times, ordinary wear and tear excepted. T-Mobile shall not be responsible to make any repairs to the Miramonte Court Reservoir (R-12) property, except as stated in the City's License Agreement (A00-139) and except for damage to the Miramonte Court Reservoir (R-12) property caused by T-Mobile, its employees, agents, contractors, subcontractors, subtenants or invitees. 8. The exterior of all telecommunications equipment, conduit, and any other component attached to the City's reservoir shall be comprised of non - reflective material(s) and painted to match the color of the reservoir, as approved by the City. 9. All facility equipment or other equipment associated with the operation of the facility, including but not limited to transmission cables, shall either be screened or located within a building, enclosure, or underground in a manner that complies with the development standards for this project. 10. No portion or extension of any telecommunication facility, including without limitation any guy wires, shall protrude beyond property lines or extend into any portion of property where such facility is not itself permitted. 11. No communication facility shall be located In a required parking area, vehicle maneuvering area, or pedestrian circulation area In such a manner that it interferes with, or in any way impairs, the utility or intended function of such area. Construction plans shall include landscape plans to be reviewed and approved by the Community Development Department and the Public Works Department. 15. Prior to construction plan submitta►, the applicant shall contact the Public Works Department to obtain the exact locations for the six (6) twenty-four inch (24") box Tipuana Tipu trees to be planted within the existing City - owned and maintained open space (Lot V of Tract 13249-6). 16.
