A2017-078 BETWEEN THE CITY OF CHINO HILLS AND VCS ENVIRONMENTAL THIS AMENDMENT No. 1 to Agreement No. A2017-078, dated March 17, 2017, is entered into in the State of California by and between the City of Chino Hills, a California general law municipal corporation, hereinafter called "City", and VCS Environmental, hereinafter called "Contractor". Review all Permits associated with the Peyton Drive, Eucalyptus Avenue and English Channel Improvements HMMP (Peyton Drive HMMP). Report in letter form or as requested by the City. 2. Analyze City's proposal to USACE and CDFW as to relationship to the commitments/requirements contained in the Peyton Drive HMMP (see attached February 16, 2017 letter). 3. Amend (via document addendum) the Peyton Drive HMMP to include additional compensatory mitigation elements contained in the City's February 16, 2017 letter to USACE, findings from Permit Fillet, and other relevant information that pertains to the matters contained in the City's February 16, 2017 letter . Reference March 3, 2017 VCS Proposal (attached) as shown below: 1). Permit Fillet / Letter to the agencies on tasks and schedule 2). Site tour with the City staff to review the mitigation areas 3). Amend/ Errata for the HMMP Amended Scope of Work - Per Amendment 1 submitted 7/26/2017 4. Review the May 2017 incident where surveyor for AKM, the City's contract engineer for the Mitigation project, entered the mitigation area without the accompaniment of a biological monitor and cut vegetation to gain line of sight. 5. Provide City personnel with the information on ways and processes within CDFW, USACE, Regional Board, and US Fish and Wildlife that weigh on the successful handling of the May 2017 project surveyor incursion matter. 6. VCS will assist with any conference call arranged to deal with as an update to the existing HMMP Addendum. 7. After CDFW, and other relevant regulatory authorities authorize the handling of the May 2017 incursion by incorporating the incident into the current HMMP Addendum, VCS will update the existing Addendum, write an appropriate cover e-mail and redistribute to the regulators for comment. VCS will also answer any inquiries regarding the updated Amendment, and reissue as appropriate. 8. VCS will Provide other consultation service on a limited "as needed" basis for such issues as construction quality control, and basic project management advice.
