On May 23, 2006, the Community Development Director approved Site Development Permit 05SDP19 for an unmanned wireless telecommunication facility for Cingular Wireless (now known as the New AT&T) to be installed on an existing Southern California Edison (SCE) tower on City-owned open space, located west of Peyton Drive and east of Lost Trail Drive. The project site is designated on the General Plan Land Use Map as Open Space, and is zoned Planned Development PD 24-145. The original approval allowed for the attachment of twelve (12) panel antennas at 43'-0" above ground level (AGL) on an existing SCE lattice tower and nine (9) equipment cabinets within a lease area adjacent to the SCE tower. Now, AT&T is proposing to attach six (6) panel antennas and four (4) equipment cabinets. The four (4) equipment cabinets will be installed in the same lease area adjacent to the SCE tower. To minimize the visual impact of the wireless facility, the applicant is proposing a variety of trees, shrubs, and vines to screen the equipment shelter from adjacent residents and Peyton Drive: According to the original Condition of Approval #1 for 05SDP19, the Site Development Permit (SDP) shall become null and void if all conditions of approval have not been complied with and the Permit is not used within one (1) year of the date of approval, which was May 23, 2007. On September 17, 2007, staff approved a request for an extension of time for 05SDP19. The proposal included attaching antennas to the legs of an existing SCE tower and an equipment shelter to house the necessary support equipment for the site. Chapter 16.44 of the Chino Hills Development Code requires an administrative approval of a Site Development Permit to attach a new wireless communication facility to an existing structure. On May 23, 2006, the Community Development Director approved Site Development Permit 05SDP19, subject to the Conditions of Approval. According to the original Condition of Approval #1 for 05SDP19, the SDP shall become null and void if all conditions of approval have not been complied with and the Permit is not used within one (1) year of the date of approval, which would expire on May 23, 2007. The Director of Community Development, or designee may grant one extension of time for a period not to exceed one (1) year, provided an application requesting the extension is filed with the Planning Division. Prior to the May 23, 2007 expiration date of 05SDP19, the applicant submitted their request for an extension of time for the SDP. The applicant stated the reasons permits were not pulled for the project in a timely manner was due to the merger of Cingular airWireless with AT&T in 2006-2007. The merger between the two wireless companies put many approved sites on hold while the New AT&T evaluated proposed sites, existing infrastructure, and customer needs in order to determine the best possible network of facilities to best serve their customers. Therefore, due to the merger putting this site (and many others) on hold, the applicant received administrative approval on September 17, 2007, for an extension of time for Site Development Permit 05SDP19 to a new expiration date of September 17, 2008. On August 14, 2008, the applicant contacted City staff and requested a second extension of time for 05SDP19 because of delays caused by leasing and easement related matters that have stalled the project from being completed within the one-year extension. Condition of Approval #1 for 05SDP19 only allows for one extension of time, which has already occurred. As of September 17, 2008, Site Development Permit 05SDP19 has become null and void since all conditions of approval have not been complied with and substantial construction activity has not occurred within the granted time extension of one additional year. The City's protocol established by the Development Code is to enforce the expiration date of September 17, 2008 for 05SDP19. Since the applicant made a request for a second extension of time and submitted a new Site Development Permit application before September 17, 2008, as well as provided valid reasons for needing a second extension of time, City staff is able to assist the applicant in requesting a second extension of time instead of moving forward with City procedures for revocation of entitled 05SDP19. City staff has verified that AT&T is currently going through the process of recording a Communications License Agreement with the City and recording access and utility easements with Southern California Edison (SCE) and the City. The Meeting Date: October 21, 2008 Page 5 of 9 SUBJECT: AMENDMENT TO ENTITLED SITE DEVELOPMENT PERMIT 05SDP19—AT&T VNRELESS 1111, recording of both documents can take long periods of time. The entitled project meets all current Development Code standards in that AT&T is proposing to locate the equipment partially underground within an equipment shelter as well as paint all minor above ground equipment to match the existing SCE tower or the surrounding area. To minimize the visual impact of the wireless facility, the applicant is proposing a variety of trees, shrubs, and vines to screen the equipment shelter from adjacent residents and Peyton Drive. Condition of Approval #1 for 05SDP19 only allows for one extension of time, which has already occurred. Therefore, the only way for the applicant to receive a second extension of time for 05SDP19 is through the discretionary approval by the Planning Commission for an amendment to Condition of Approval #1 to extend the expiration date from September 17, 2008, to a new expiration date of September 17, 2009. A discretionary approval by the Planning Commission would allow necessary time for the applicant to resolve leasing and easement related matters and move forward with the development of the project. Staff has reviewed the project plans and has determined that the proposed project plans are mostly consistent with the original approved project plans dated May 23, 2006, with minor modifications. AT&T has reduced the number of panel antennas from twelve (12) to six (6) and reduced the total equipment cabinets from nine (9) to four (4). 16 A modification is being proposed for the height installation of two (2) panel antennas from 43-0" to 34'-9" on the existing SCE tower. The total lease area needed for this project will remain the same as originally approved. The overall project is in conformance with the Development Code. APPROVAL REQUIRED The applicant is seeking an approval from the Planning Commission for the following: • An amendment to the Conditions of Approval for the entitled Site Development Permit 05SDP19 to extend the expiration date from September 17, 2008, to a new expiration date of September 17, 2009, to allow necessary time for the applicant to resolve leasing and easement related matters and move forward with the development of the project. The following Conditions of Approval are being revised: 1. This Site Development Permit (SDP) shall become null and void if all conditions of approval have not been complied with and the Permit is not used within one (1) year of September 17, 2008. There is no more time extension allowed after this expiration. "Used" as referred to in this Condition means the commencement of substantial construction activity or any activity authorized by the approval. If an extension of time is not 410- granted, the SDP shall expire and a new application shall be required. Meeting Date: October 21, 2008 Page 6 of 9 SUBJECT: AMENDMENT TO ENTITLED SITE DEVELOPMENT PERMIT 05SDP19—AT&T WIRELESS 29. Precise grading plans complying with the provisions of Appendix Chapter J of the California Building Code and the Chino Hills Development Code shall be submitted to the Building and Safety Division for review and approval. The following Conditions of Approval are being added: 13. Cables shall be installed Inside" the tower legs and painted to match the color of the tower. The antennas shall also be painted to match the color of the tower. 14. All areas disturbed in construction and/or trenching for conduit shall be repaired/replaced to City standards prior to commencement of operation. The following Conditions of Approval are being deleted: 51. The Applicant shall organize a pre-construction meeting with the Senior Landscape Planner before landscape development is installed within right- of ways and publicly owned lots. 52. All landscape development field reviews by the Senior Landscape Planner shall be requested at least 48 hours in advance. 4111, 54. A Certificate of Substantial Completion for the project's landscape development shall be submitted and reviewed by the Senior Landscape Planner. Once the final document package is accepted, a final walk, with the Senior Landscape Planner shall be scheduled to review consistency with the accepted Certificate of Substantial Completion documents. When both the Certificate of Substantial Completion and Final Walk are completed, the release of Certificate of Occupancy may occur. PROPOSAL /ANALYSIS The applicant is requesting approval of an amendment to the Conditions of Approval for the entitled Site Development Permit 05SDP19 to extend the expiration date from September 17, 2008, to a new expiration date of September 17, 2009. The entitled Site Development Permit 05SDP19 is in accordance with Chapters 16.44 and 16.78 of the Development Code for the construction of an unmanned wireless communication facility to be located on an existing SCE Tower located on City-owned open space west of Peyton Drive and east of Lost Trail Drive Site Development Permit 05SDP19 includes the attachment of six (6) panel antennas and four (4) equipment cabinets. Four (4) panel antennas will be installed at 43'-0" AGL and two (2) panel antennas will be installed at 34'-9" AGL on the existing SCE tower (Exhibit A). The four (4) equipment cabinets will be installed in the same lease area adjacent to the SCE tower. The equipment shelter is located on City owned property, outside of the SCE easement and will be partially underground with new landscaping to minimize its visibility to the surrounding area (Exhibit A). Meeting Date: October 21, 2008 Page 7 of 9 SUBJECT: AMENDMENT TO ENTITLED SITE DEVELOPMENT PERMIT 05SDP19—AT&T WIRELESS 41 DEVELOPMENT STANDARDS Section 16.18 — Recreation and Open Space District does not specify any development standards in Open Space. Building Height AT&T is not proposing to increase the existing 80'-0" SCE lattice tower. A total of six (6) panel antennas will be installed on the existing SCE tower. Four (4) panel antennas will be placed on the tower at approximately 43'-0" AGL and two (2) panel antennas will be place at approximately 34'-9". The equipment shelter will be located adjacent to the SCE Tower, with a proposed height of 3'-6". Eouioment Screenina The applicant is proposing to locate the majority of AT&T's telecommunications equipment partially underground within an equipment shelter. Approximately 3'-6" of the top portion of the equipment shelter will be above ground, but will be screened by a variety of trees, shrubs, and vines. The six (6) panel antennas that will be attached to the existing SCE tower will be painted to match the existing tower (Condition of Approval #13). Buildina Setback The City of Chino Hills does not have setback standards for Open Space. Grading The only grading proposed for the project is to grade down the equipment shelter pad 6'-0" to minimize its visual impact. Minor earth movement will be necessary to trench for power and telephone services. The surfaces and/or materials removed or damaged will be replaced with matching surface and/or material (Condition of Approval #11). All grading will be performed in accordance with the approved grading plan. Any surface damaged in the grading or trenching will be replaced to City standards (Condition of Approval #29). Parkina. Traffic and Access The proposed use is an unmanned facility and AT&T remotely monitors equipment. Maintenance requires approximately four to six visits per year. Therefore, it will not impact parking, traffic, or access to the existing site. The existing 12'-0" wide access drive lane to the SCE tower shall remain clear and unobstructed at all times (Condition of Approval #12). Meeting Date: October 21, 2008 Page 8 of 9 SUBJECT: AMENDMENT TO ENTITLED SITE DEVELOPMENT PERMIT 05SDP19—AT&T VVIRELESS Landscaping and Irrigation AT&T is proposing a combination of trees, shrubs, and vines to screen the proposed equipment shelter to minimize the visual impact to the adjacent area. The applicant is required to submit project plans that show adequate irrigation for the proposed landscaping (Condition of Approval #23). AT&T will be required to replace any damaged landscaping with an equivalent size to the satisfaction of the Community Development Department (Condition of Approval #24). Existing trees within the project area shall not be removed (Condition of Approval #25). Signs Signs will be placed at the site in accordance with FCC standards. ARCHITECTURE The proposed wireless telecommunications facility design will consist of mounting six (6) panel antennas to an existing SCE Tower. The cables will be run inside the tower legs and the antennas will be painted to match the color of the SCE tower (Condition of Approval #13). GENERAL PLAN CONSISTENCY AND ZONING CONSISTENCYlihr , The entitled project site is designated as Open Space on the General Plan and is zoned as Planned Development (PD) 24-145. The proposed AT&T antennas are to be mounted on an existing SCE tower, which required a Site Development Permit approval for its location on the SCE tower in Open Space, consistent with Development Code requirements. Approval of the proposed project furthers Major Goal 2 of the General Plan by providing "A high quality of life for all residents". In providing AT&T the opportunity to better serve their customers in Chino Hills, the City furthers its goal of providing a high quality of life. Therefore, the approval of an amendment to the Conditions of Approval for the entitled Site Development Permit 05SDP19, subject to the attached Conditions of Approval, is consistent with the General Plan. COMMUNICATION LICENSE AGREEMENT Installation of a Communications Facility on City property requires that the City Council execute a Communications License Agreement with the applicant. Pursuant to Section 16.44.070 of the Chino Hills Development Code, leasing of City-owned property for the purpose of erecting a Communications Facility requires a negotiated License Agreement. The existence of the License Agreement does not relieve the applicant of any obligations to obtain permits as required by the City Code(s). If the License Agreement is approved by City Council, AT&T will be required to pay an annual rent because the facility is located on City-owned property. Meeting Date: October 21, 2008 Page 9 of 9 SUBJECT: AMENDMENT TO ENTITLED SITE DEVELOPMENT PERMIT 05SDP19 —AT&T WIRELESS FISCAL IMPACT The License Agreement with AT&T is currently being negotiated with the City. There will be minimal fiscal impacts to the City associated with the construction of the proposed project, most of which should be offset by permit fees. The leasing of City- owned property, according to the negotiated License Agreement will generate additional revenue for the City, which is yet to be determined. ENVIRONMENTAL ASSESSMENT Staff has determined that the proposed use is exempt from the California Environmental Quality Act under section 15303 New Construction or Conversion of Small Structures because the proposed AT&T Telecommunications facility will expand the wireless coverage utility services for their customers in Chino Hills, which will have negligible impact on the environment. The proposed project consists of minor additions to an existing utility structure. PC2008 — A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHINO HILLS ADOPTING AN AMENDMENT TO THE CONDITIONS OF APPROVAL FOR THE ENTITLED SITE DEVELOPMENT PERMIT 05SDP19 FOR A SECOND EXTENSION OF TIME FOR A NEW AT&T TELECOMMUNICATIONS FACILITY LOCATED ON AN EXISTING SOUTHERN CALIFORNIA EDISON TOWER IN OPEN SPACE WEST OF PEYTON DRIVE AND EAST OF LOST TRAIL DRIVE THE PLANNING COMMISSION OF THE CITY OF CHINO HILLS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission does hereby make the following findings of fact: A. The applicant, Michael Blackwell of SRES, a representative for the New AT&T, requested approval of an amendment to the Conditions of Approval for the entitled Site Development Permit 05SDP19 for a second extension of time for a new AT&T telecommunications facility located on an existing Southern California Edison (SCE) tower in open space, west of Peyton Drive and east of Lost Trail Drive. B. The site is located on City -owned open space, west of Peyton Drive and east of Lost Trail Drive, and is legally described as Assessor's Parcel Numbers (APN) 1032-231-68 and -69, as shown in the latest records of the Office of the Tax Assessor of the County of San Bernardino. C. The property has a General Plan designation of Open Space and is zoned Planned Development (PD) 24-145. D. The project is exempt from the requirement of the California Environmental Quality Act Guidelines pursuant to Section 15303 New Construction or Conversion of Small Structures because the proposed AT&T Communications facility will expand the wireless coverage utility services for their customers in Chino Hills, which will have negligible impact on the environment. E. The Planning Commission of the City of Chino Hills held a duly noticed public meeting on October 21, 2008, to review and consider the staff report prepared for the project, receive public testimony, and review all correspondence received on the project. 1 OF 5 SECTION 2. With regard to the request for approval of an amendment to the entitled Site Development Permit 05SDP19, based upon oral and written testimony and other evidence received at the public meeting held for the project, and upon studies and investigations made by the Planning Commission and on its behalf, the Planning Commission does further find as follows: A. FINDING: The requested Site Development Permit will not adversely affect the purpose and intent of Chapter 16.78 - Site Development Permits and the proposed use is consistent with the City of Chino Hills General Plan. FACT: The proposed project does not adversely affect the purpose and intent of Chapter 16.78, in that the proposed use will have a negligible impact on the surrounding area. The antennas to be placed on the existing SCE tower will be painted to match the structure, and the equipment will be housed within an equipment shelter. The proposed project is consistent with Major Goal 2 of the General Plan, which is to provide a high quality of life for all residents. In providing AT&T the opportunity to better serve their customers in Chino Hills, the City furthers its goal of providing a high quality of life. B. FINDING: The proposed use is consistent with the provisions of the Development Code for the city. FACT: The project site is zoned PD 24-145. Within PD 24-145, the area is designated as open space. Chapter 16.44 - Wireless Communication Facilities requires that wireless communications facilities located in open space be collocated on existing equipment and/or structures only. No new structures may be built in open space for the purpose of accommodating wireless facilities. The proposed project complies with Development Code standards in that the antennas will be placed on an existing SCE tower, and the equipment will be housed in a partially underground equipment shelter with new landscaping to minimize its visibility to the surrounding area. C. FINDING: The proposed use will not have significant adverse effects on adjoining land uses and other permitted uses of the area in which it is proposed to be located. FACT: The proposed wireless communication facility will not have adverse impacts on the surrounding land uses. The 2 OF 5 proposed antennas and cables will be painted to match the existing SCE tower, and the equipment will be housed in a partially underground equipment shelter with new landscaping to minimize its visibility to the surrounding area. The minimal equipment that will be above ground will be painted to blend with the surrounding area. The design of the proposed project will have a minimal impact on the visual character of the open space in which it is located as well as from the surrounding streets and neighborhoods. The proposed use complies with federal, state and local guidelines for safety, and will not affect the surrounding neighborhood. D. FINDING: The approval of the permit application is in compliance with the requirements of the California Environmental Quality Act (CEQA). FACT: The proposed project is in compliance with CEQA under Section 15303 New Construction or Conversion of Small Structures because the proposed AT&T Communications facility will expand the wireless coverage utility services for their customers in Chino Hills, which will have negligible impact on the environment. The proposed project consists of minor additions to an existing utility structure. E. FINDING: The application will not result in conditions or circumstances contrary to the public health, safety and general welfare of the city. FACT: The Federal Communication Commission rules require wireless facilities to comply with the radio frequency exposure guidelines. The limits established in the guidelines are designed to protect the public health with a very large margin of safety. These limits have been endorsed by federal health and safety agencies such as the Environmental Protection Agency and the Food and Drug Administration. The AT&T site complies with these standards, and the proposed use will not create adverse conditions that threaten the health, safety, and welfare of the city or residents. SECTION 3. Based on the findings and conclusions set forth above, the Planning Commission hereby approves an amendment to the Conditions of Approval for the entitled Site Development Permit 05SDP19 for a second extension of time for a new AT&T telecommunications facility, subject to the Conditions of Approval dated August 5, 2008, and the Project Plans labeled as Exhibit "A". This Site Development Permit (SDP) shall become null and void if all conditions of approval have not been complied with and the Permit is not used within one (1) year of September 17, 2008. There is no more time extension allowed after this expiration. "Used” as referred to in this Condition means the commencement of substantial construction activity or any activity authorized by the approval. If an extension of time is not granted, the SDP shall expire and a new application shall be required. 2. In addition to the City's right to revoke or revise this Site Development Permit for violation of any of the conditions herein; pursuant to Section 16.78.090 and 16.44.110 of the Chino Hills Development Code, the City, its Planning Commission and its City Council retain and reserve the rights and jurisdiction to review and modify all Site Development Permits approved by the City, including the conditions of approval, based on changed circumstances. Changed circumstances include, but are not limited to, the following in relation to the approved facility as described and diagrammed in the related Site Plan: increased height or size of the facility; additional impairment of the viewshed from surrounding properties; change in the type of antenna or support structure; change of color and materials; substantial change in location on the site; and an effective increase in signal output above or near Maximum Permissible Exposure (MPE) limits imposed by the Revised Radio Frequency Emission Guidelines by the Federal Communications Commission. 3. The applicant or its successors in interest shall indemnify, protect, defend (with legal counsel reasonably acceptable to the City), and hold harmless, the City, and any agency or instrumentality thereof, and its elected and appointed officials, officers, employees, and agents from and against any and all liabilities, claims, actions, causes of action, proceedings, suits, damages, judgments, liens, levies, costs, and expenses of whatever nature, including reasonable attorney's fees and disbursements (collectively "Claims") arising out of or in any way relating to this project, any discretionary approvals granted by the City related to the development of the project, or the environmental review conducted under California Environmental Quality Act, Public Resources Code Section 21000 et seq., for the project. If the City Attorney is required to enforce any conditions of approval, the applicant shall pay for all costs, including attorney's fees. The project shall be in substantial conformance with the site plan, design plan and conditions set forth in the Site Development Permit during construction of the communication facility. No modification to the Site Plan, Design Plan or the Conditions of Approval for the Site Development Permit shall be permitted without the approval of the Director of Community Development or his/her designee. 5. All communication facilities to be installed as part of AT&T Wireless shall not bear any signs or advertising devices other than certification, warning, or other required seal or required signage. 6. All accessory equipment, or other equipment associated with the operation of the facilities, including but not limited to transmission cables, shall be located within a building, enclosure, or underground in a manner that complies with the development standards for this project. 7. No portion or extension of any Communication Facility, including without limitation any guy wires, shall protrude beyond property lines or extend into any portion of property where such facility is not itself permitted. 8. No Communication Facility shall be located in a required parking area, vehicle maneuvering area, or pedestrian circulation area in such a manner that it interferes with, or in any way impairs, the utility of intended function of such area. 9. No Wireless Communication Facility or accessory equipment as part of AT&T Wireless shall interfere with any transmission signal or form of communication, including but not limited to cable televisions, City or emergency wireless communications. 10. The applicant shall submit a Horizontal Control Plan (HCP) to the Planning Division for review and approval prior to the submittal of construction plans. 11. Surfaces and/or materials removed or damaged will be replaced with matching surface and/or material and shall meet City standards. 12. The 12' wide asphalt access driveway to the SCE tower shall remain clear and unobstructed at all times. 13. Cables shall be installed "inside" the tower legs and painted to match the color of the tower. The antennas shall also be painted to match the color of the tower. 14. All areas disturbed in construction and/or trenching for conduit shall be repaired/replaced to City standards prior to commencement of operation. Access and Utility easements shall be reviewed, approved and recorded prior to issuance of Building Permit. 16. Lease agreements shall be approved by the City Council prior to approval and recordation of access and utility easements. Landscape Development 17. All landscape architecture documents and landscape construction shall comply with the City of Chino Hills Landscaping and Lighting Manual 1992. 18. All landscape architecture documents, used as part of the entitlement and landscape construction process, shall be designed by a registered landscape architect licensed by the State of California 19. After the City's approval of the landscape architecture documents, all future revisions shall be reviewed by the City for conformance to the City's ordinances and regulations. Minor changes may be outlined within the applicant's memorandum of design alteration and accepted by the City. The applicant shall resubmit major changes for review and approval. 20. All trees shall be placed outside of the public utility easement based on the trees mature size. Use Sunset's Western Garden Book as a reference to determine mature size. 21. All trees shall be 15-gallon nursery stock. Nine (9) trees shall be Toyons. Six (6) trees shall be Oaks resistant to oak root fungus. The landscape architect shall specify a minimum tree height and breadth from the nursery for Community Development Department approval. 22. Using vines, Carolina Jessamine shall be planted at 8-foot intervals using 5- gallon nursery stock. At least eleven (11) plants shall be specified. The landscape architect shall specify a minimum vine height and breadth from the nursery for Community Development Department approval. The vines shall be secured and trained on all the walls. 23. Add three (3) separate irrigation valves to irrigate the vines and trees species with pop-up bubblers. These three (3) valves shall be connected to the City's central irrigation system. All new graded surfaces not immediately involved in construction shall have an approved method of erosion protection in place at all times. No building permits shall be issued until compliance with the above requirements has been demonstrated. Landscape Development 45.
