August 2, 2016 TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: CITY MANAGER SUBJECT: CONTRACT WITH HARDY & HARPER, INC. FOR CONSTRUCTION OF THE FY 2016-17 STREET IMPROVEMENT PROJECT RECOMMENDATION: 1. Award a contract to Hardy & Harper, Inc. in the amount of $1,039,000 for the FY 2016-17 Street Improvement Project. 2. Authorize staff to issue a Notice of Award. 3. Authorize staff to accept the performance and payment bonds, proof of insurance, and issue a Notice to Proceed upon receipt and acceptance of such. 4. Authorize the City Manager, at his discretion, to approve cumulative change orders up to 5% ($51,950) of the awarded contract amount. BACKGROUND/ANALYSIS: On June 28, 2016, the City Council approved the plans and specifications and authorized staff to solicit bids for the project. On July 21, 2016, five (5) bids were received and are summarized as follows: CONTRACTOR BID AMOUNT 1. Hardy & Harper, Inc. $1,039,000.00 2. All American Asphalt $1,151,800.00 3. Sully Miller Contracting Co. j $1,290,000,00 14. The R.J. Noble Company j $1,328,071.98 15. COPP Contracting, Inc. j $1,588,373.27 Engineer's Estimate: $1,200,000.00 225/332 AGENDA DATE: AUGUST 9, 2016 PAGE 2 SUBJECT: CONTRACT WITH HARDY & HARPER, INC. FOR CONSTRUCTION OF THE FY 2016-17 STREET IMPROVEMENT PROJECT The contracts for competitively bidding public projects must be awarded to the lowest responsible bidder. As shown above, Hardy & Harper, Inc. submitted the lowest base bid and was indicated as the apparent low bidder. Staff received favorable reports from references regarding the work performed by Hardy & Harper, Inc. and recommends that the Council award them a contract in the amount of $1,039,000. CEQA REVIEW: At the June 28, 2016 City Council meeting, the project was determined to be exempt as a Class 1(c) Categorical Exemption, (existing highway and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities), pursuant to Section 15301 of Guidelines for the California Environmental Quality Act of 1970, as amended, Public Resources Code section 21000 of seq. REVIEW BY OTHERS: This agenda item has been reviewed by the Finance Director. FISCAL IMPACT: This project is funded by the Street Improvement Program which is included in the FY 2016-17 Capital Improvement Program budget.
