RECOMMENDATION: iENDATION: 1. Accept the Lower Los Serranos Skate Park Channel Outlet and Box Culvert Sediment Removal Project by Jeremy Harris Construction, Inc. as complete. 2. Authorize the City Clerk to cause the Notice of Completion to be recorded. 3. Authorize the release of retention monies in the amount of $11,711.30, forty-five days after acceptance of the work by the City Council. 4. Authorize the release of any remaining encumbrance after final payment of retention. 5. Reduce the amount of the Performance Bond down to 15% for warranty purposes for a period of one year. 6. Authorize the release of the Labor and Materials Bond six months after project acceptance. BACKGROUND/ANALYSIS: On September 22, 2015, the City Council awarded a contract to Jeremy Harris Construction, Inc. (Contractor) in the amount of $225,545,00 for the Lower Los Serranos Skate Park Channel Outlet and Box Culvert — Sediment Removal Project. The Notice to Proceed was issued on October 12, 2015 and the project was deemed complete on January 22, 2018. The project removed 7,400 cubic yards of sediment from the Skate Park Channel Outlet and 2,000 cubic yards of sediment from the Box Culvert. The quantity of sediment removed from the Skate Park Channel Outlet was over 25 percent less than the 105/470 AGENDA DATE: FEBRUARY 0, 2016 PAGE 2 SUBJECT: NOTICE OF COMPLETION FOR CONSTRUCTION OF THE LOWER LOS SERRANOS SKATE PARK CHANNEL OUTLET AND BOX CULVERT SEDIMENT REMOVAL PROJECT BY JEREMY HARRIS CONSTRUCTION, INC. engineer's estimate. Therefore, in accordance with the Standard Specification for Public Works, a price increase of $25,530 was negotiated to account for the difference of 2,600 cubic yards in the bid quantity. During the course of construction, Change Order No, x1 was needed to widen the pilot channel that conveys flows through the tree lined area south of the Skate Park Channel Outlet. On December 15, 2015, the City Manager approved Change Order No.1, which included an amount of $18,931 for the pilot channel widening, the increase of $25,530 to account for lower sediment removal quantities than listed in the bid documents, and a City credit of $35,800 for savings on sediment removal and trucking costs realized during grading operations. The net value of Change Order No. 'l was $8,581.00. The final contract amount is summarized below: Original Contract 225,645.00 Change Order No. 1 1 $ 8,581.00 Revised Contract I $234,226.00 REVIEW BY OTHERS: This agenda item has been reviewed by the Finance Director, City Engineer and the Contract Compliance Officer. FISCAL IMPACT: This project was included in the approved FY 2015-16 Capital Improvement Program budget. CEA REVIEW The City of Chino Hills prepared an Initial Study to determine if the proposed project would have a significant adverse effect on the environment. The Initial Study found that, although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because of the mitigation measures imposed by the Santa Ana Regional Water Quality Board, the California Department of Fish and Wildlife, and the United States Army Corp of Engineers. Consequently, a Mitigated Negative Declaration was prepared for the Project and adopted by the City Council on August 23, 2011 ("NAND"). The awarding of a contract is a necessarily included element of the project considered in the MND, and therefore the MND adequately addressed the environmental impacts. No substantial changes have been made in the project, and no substantial changes in the circumstances under which the project is being undertaken and no new information of substantial importance to the project which was not known or could not have been known when the M N I was adopted have become known. In addition, all Mitigation Measures have or are being complied with.
