BACKGROUND/ANALYSIS: In August 2000, the City Council approved a five-year agreement with the Chino Valley Unified School District (CVUSD) to equally share the cost of a Deputy for ten months for a full-time School Resource rce Officer (SRO) at Ayala High School. In August 2005 an additional SRO posted at Chino Hills High School was added to the contract. The contract for SRO services with the CVUSD at the two Chino Hills High Schools has been extended for additional five year terms as needed. The most recent agreement expired on June 30, 2015. City staff has been working with CVUSD to secure a new agreement to continue the SRO program sharing arrangement. The attached agreement was approved by the CVUSD School Board on January 7, 2016. Despite the expiration of the agreement, SRO services have continued without interruption at Ayala and Chino Hills High Schools while City and CVUSD staff developed a new agreement. The SRO program continues to foster strong collaboration between Chino Hills and CVUSD. Results of this effort include immediate police response, prompt resolutions of criminal activity, student law enforcement interaction and crime prevention. 86/470 AGENDA DATE: FEBRUARY 9, 2016 PAGE TWO SUBJECT: SCHOOL RESOURCE RCE OFFICER PROGRAM AGREEMENT BETWEEN THE CITY OF CHINO HILLS AND THE CHINO VALLEY UNIFIED SCHOOL DISTRICT The cost for two SROs for FY 2015/16 will be split between the City and CVUSD., The total ten-month cost for FY 2015116 is not to exceed $425,051 of which the City's share of this cost is $212,525.50. This is an increase of$12,714.00 per agency, or$25,428,00 total, from last year's cost. Overtime and vehicle costs, including fuel and maintenance, will be shared equally between the City and CVUSD and will be billed in three equal installments. Per the agreement the cost of the School Resource Officer may be adjusted at any time to reflect salary or fringe benefit increases that affect Chino Hills' contract with the San Bernardino County Sheriff's Department. Overtime must be authorized by both parties and costs shared equally. REVIEW BY OTHERS: This item has been reviewed by the Finance Director. FISCAL IMPACT: The cost has been included in the FY 2015/16 Budget. CEQA REVIEW: This action is not a project within the meaning of the CEQA Guidelines Section 15278 and is therefore exempt from CEQA as it is an administrative change that will not result in any direct or indirect physical change in the environment. It is therefore exempt from CEQA. Respectfully submitted, Re . mended by: Ate A Ben Montgomery Konradt Bartlam City Manager Deputy City Manager KB:B :ss r Attachment: CVUSD and City of Chino Hills for School Resource Officer Program Agreement 87/470 ES-1616-043 AGREEMENT BETWEEN THE CHINO VALLEY UNIFIED SCHOOL DISTRICT AND THE CITY OF CHINO HILLS FOR THE SCHOOL RESOURCE OFFICER PROGRAM This Agreement by and between the City of Chino Hills (hereinafter "CITY") and the Chino Valley Unified School District (hereinafter "DISTRICT") is effective for the 2015- 2016 school year (September 1, 2015 through June 30, 2016) and effective for a period not to exceed five years. WHERES, CITY and DISTRICT wish to jointly establish a School Resource Officer Program as a partnership of school, staff, and public service persons to respond to student needs within the school setting. NOW, THEREFORE, it is hereby agreed between the parties as follows; 1. Services of the School Resource Officers: The CITY shall be responsible for the day-to-day administration of the School Resource Officer Program. CITY agrees to make available sufficient information concerning the administration-of the program_and .............. shall be the employer of the School Resource Officer for all purposes. There will be two Officers. One Officer wilt be assigned to Ayala High School campus and one to Chino Hills High School campus;- Each Officer assigned a campus will be on campus in uniform during the school year and will be responsible for all law enforcement actions and liaison with that school. His/her involvement will require meeting and coordinating with school officials and school district security as well as planning for special events and sports activities. This,does not, however, preclude the Officers from taking police actions, as he/she may deem necessary. The services of the two Officers will• be provided between the dates of September 1, 2015 through June 30, 2016, at high schools located in the City of Chino Hills when mutually agreed upon by the DISTRICT and the CITY for approximately 40 hods per week. The actual work schedule will be contingent upon police officer contract guidelines and the time classes are taught during the school year. 2. Funding Conditions The DISTRICT agrees to pay one half of the cost of the two Officers for ten months, for an,amount not to exceed $212,525.50, excluding overtime and subject to continued State Grant funding to the District. Any adjustments in cost will be set annually by amendments. All overtime will 1 of 8 88/470 ES-1516-043 be authorized by the DISTRICT in concurrence with the CITY on a case- by-case basis and will be shared equally by both entities (50% each). The CITY shall bill the DISTRICT for its share in three equal installments. The first installment of shall be due November 30, the second installment due January 31, and the third installment due June 30. Further, as long as the City of Chino Hills contracts with the San Bernardino County Sheriff's Department for law enforcement services, the cost of the School Resource Officers may be adjusted at any time due to any salary or fringe benefit increases, which may be granted by the Board of Supervisors to the Sheriff's employees. Should an officer not be provided to either school, DISTRICT shall be entitled to a credit on the next billing equal to its share of the daily cost for each officer not provided. The credit due for each officer will be calculated by dividing the DISTRICT'S annual cost of one officer by the number of days in the school year and then multiplying that result by the number of days the officer was not available. 3. Terms of Agreement This Agreement shall remain in full force and effect until June 30, 2020. Prior to October 15th of each successive year, the DISTRICT and the CITY will issue an Addendum renewing, changing or modifying the existing contract terms. Additionally, either party may terminate this Agreement duringtheterm by providing thirty days written-notice to the other party. This Agreement may be renewed, altered, or amended at any time in whole or in part by mutual written consent of both parties. 4. Indemnity: Pursuant to Government Code Section 895.4, the CITY agrees to indemnify the DISTRICT for all damages causes by any negligence or unlawful act or unlawful act or omissions by any employee or official of the CITY in the performance of this Agreement.
