Determine pursuant to Government Code Section 54221 that a portion of City property, Assessor Parcel Number 1023-691-07, is no longer necessary for City or other public purposes. iip 2. Adopt a Resolution entitled: "A Resolution Of The City Council Of The City Of Chino Hills,Approving The Sale Of Certain Surplus Real Property,APNs 1022-301-28, 1022- 601-29, And 1022-601-30, To Casa—TREH IX LLC And Authorizing The Execution Of An Agreement And Grant Deed Therefor." Sale Price is $272,250.00. 3. Authorize the recordation of the Grant Deed. BACKGROUND/ANALYSIS: In May 2002, November 2002, and February 2005, the Planning Commission and City Council approved several planning entitlements including a General Plan Amendment, Zone Change, Site Plan Reviews, and a Conditional Use Permit to facilitate the development of Gateway Village shopping center. In June of 2006, Tom Robinson, the owner of Gateway Village, presented a request to the City regarding the acquisition and development of the subject property. Staff reviewed the property based on location, configuration, and surrounding land uses and recommended to the Planning Commission and City Council that the site no longer served a public purpose. The site is land locked,with access from Grand Avenue only through Gateway Village. It is bordered on the east by the Chino Valley Freeway, to the south by Gateway Village commercial development, to the north by CalTrans right-of-way, and to the west by City- owned Open Space and single-family homes. In February 2007, City Council directed staff iiip to commence disposing of the property. In April of 2007, the Planning Commission recommended to the City Council that the disposal of the public property would be in conformance with the City's General Plan. Agenda Date: May 27, 2008 Page 2 SUBJECT: SURPLUS PROPERTY SALE, CITY OWNED PROPERTY APNS 4111 1022-301-28, 1022-601-29, And 1022-601-30 On April 24, 2007, the City Council passed Resolution Number 07R-11 declaring the subject property as surplus property and authorizing staff to proceed with initiating the sale of said public property. On January 22, 2008, a General Plan Amendment and a Zone Change were approved by City Council that allows the City to proceed with the required tasks to dispose of the public property in question. On April 26, 2008, the City solicited bids for the sale of the property and received one bid in response to that solicitation. Staff has reviewed that bid and has determined that it meets all the criteria for the City to proceed with the sale REVIEW BY AFFECTED DEPARTMENTS: This item has been reviewed and approved as to form by the City Attorney. La Belle, City Manager Ka hleen Gotch, Assistant City Manager • RESOLUTION NO. 08R- all A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, APPROVING THE SALE OF CERTAIN SURPLUS REAL PROPERTY, APNS 1022-301-28, 1022-601- 29, AND 1022-601-30, TO CASA—TREH IX LLC AND AUTHORIZING THE EXECUTION OF AN AGREEMENT AND GRANT DEED THEREFOR WHEREAS, City real property Assessor Parcel Numbers 1022-601-28, 1022- 601-29, AND 1022-601-30 are no longer necessary for City or other public purposes; and WHEREAS, a deed and sale agreement have been prepared to convey the surplus real property to Casa-TREH IX LLC at the price of$272,250.00. NOW, THEREFORE, the City Council of the City of Chino Hills does resolve, determine, find, and order as follows: SECTION 1. That this City Council hereby approves the sale of surplus real property, Assessor Parcel Numbers 1022-601-28, 1022-601-29, AND 1022-601-30 to Casa-TREH IX LLC in the amount of $272,250.00, and the recordation of the deed in 410 accordance with the terms of the sale documents. SECTION 2. That the City Council hereby authorizes the Mayor and City Clerk to execute the Agreement for the Sale of Real Property and the Grant Deed therefor, and further authorizes the recordation of the deed in accordance with the terms of the sale documents.
