05-13-2008 CC Rpt A17 COUNCIL AGENDA STAFF REPORT CITY CLERK USE ONLY • Meeting Date: May 13, 2008 .i ` �r Public Hearing: ❑ . - c i.,. 8. rnrormuo x.... -' Discussion Item: 0 / Consent Item: EY May 6, 2008 TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: CITY MANAGER SUBJECT: RESOLUTION TO EXTEND THE ACTION TO SET TIME AND PLACE FOR THE PUBLIC HEARING OF ANNUAL ASSESSMENTS FOR THE CHINO HILLS LANDSCAPE AND LIGHTING DISTRICT NO. 1 AND THE CONFIRMATION OF THE ANNUAL ASSESSMENTS RECOMMENDATION: It is recommended that the City Council adopt a resolution entitled: 111) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF CHINO HILLS LANDSCAPE AND LIGHTING DISTRICT NO. 1, PURSUANT TO PROVISIONS OF LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ., STATE OF CALIFORNIA) EXTEND THE DATE FOR SUBMISSION OF THE ENGINEER'S REPORT BACKGROUND/ANALYSIS: • Chino Hills Landscape and Lighting District No. 1 was formed to provide street lighting, park, open space, landscaping maintenance, and improvements throughout the District. On February 12, 2008, the City Council adopted Resolution No. 08R-07 ordering the Engineer's Report for 2008-09 fiscal year and setting the date of May 13, 2008 for council review of the preliminary Engineers Report. Staff delayed the production of the preliminary report to evaluate the budget in an effort to reduce the support that the General Fund provides to the District. The approval of this resolution would extend council review of the fiscal year 2008-09preliminary Engineers Report until May 27, 2008 at which time council will be asked to set a date for the public hearing to review and set the annual assessments for the district. La Belle, City Manager Pa11agIe Public Facilities and Operations Director • • • RESOLUTION NO. 08R- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF CHINO HILLS LANDSCAPE AND LIGHTING DISTRICT NO. 1, PURSUANT TO PROVISIONS OF LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ., STATE OF CALIFORNIA) EXTEND THE DATE FOR SUBMISSION OF THE ENGINEER'S REPORT WHEREAS, Chino Hills Landscape and Lighting District No. 1 has been duly formed to generally include the Chino Hills Specific area; and WHEREAS, Chino Hills Landscape and Lighting District No. 2 was consolidated with Chino Hills Landscape and Lighting District No. 1; and WHEREAS, the consolidated District was established to provide street lighting, open space, park, landscaping, fencing, irrigation maintenance, improvements, and other similar appurtenances; and, WHEREAS, the Landscaping and Lighting Act of 1972, Streets and 4101 Highways Code, Section 22500 et seq., provides for the annual preparation of an Engineer's Report and the confirmation and levy of assessments upon the parcels within the District(s) for the estimated expenditures to provide services. WHEREAS, on February 12, 2008 the City Council of Chino Hills adopted Resolution No. 08R-07 ordering an Engineer's Report for annual assessments for Chino Hills Landscape and Lighting District No. 1, street lighting, open space, park landscaping, fencing, and irrigation maintenance to be prepared and presented to the City Council on May13, 2008. NOW THEREFORE, the City Council of the City of Chino Hills, acting in its capacity as the governing body of Chino Hills Landscape and Lighting District No. 1 does hereby resolve, determine, find, and order as follows: SECTION 1. That the presentation of the proposed report be extended from May 13, 2008 to May 27, 2008, at which time the report will be presented to the City Council at the Council Chambers of the City Hall, 2001 Grand Avenue, Chino Hills at which time a fixed time and place will be determined by the City Council when and where any and all persons having any objections to the confirmation of the charges or annexations for fiscal year 2008-09, may appear before the City Council to protest such confirmation or annexations. 41. 1 of 3 SECTION 2. The City Clerk shall certify as to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 13TH day of May 2008.
