A06-58 WITH C. J. CONSTRUCTION, INC. FOR ANNUAL MISCELLANEOUS CONCRETE REPAIRS AND OTHER RELATED ITEMS RECOMMENDATION: 1. Approve an appropriations transfer from the 2006-07 Overlay/Slurry Seal Project to the 2007-08 Sidewalk Replacement Project in the amount of $55,000 (Measure I funds only). 40 2. Approve Amendment No. 2 to Agreement No. A06-58 with C. J. Construction, Inc. for Annual Miscellaneous Concrete Repairs in the amount of $31,500, bringing the annual not-to-exceed amount to $155,000. BACKGROUND/ANALYSIS: On August 8, 2006, the City Council awarded a contract to C. J. Construction, Inc. for Annual Miscellaneous Concrete Repairs in the amount of$100,000. On January 9, 2007, the City Council approved a contract increase of$23,500 for similar work on a small Capital Improvement Program project, bringing the annual contract limit to $123,500. In anticipation of the opening of The Shoppes at Chino Hills, staff has observed a number of locations where sidewalk needs to be replaced or is completely missing along Grand Avenue. The cost to replace/repair the sidewalk is approximately $55,000. Staff is asking the City Council to transfer$55,000 in project savings from the 2006-07 Overlay/Slurry Seal project (which is complete) to the 2007-08 Sidewalk Replacement Project. In addition to the appropriations transfer, staff is asking the City Council to increase the annual services contract to a not-to-exceed total of$155,000. THIS AMENDMENT No. 2 to Agreement No. A06-58, dated May 13, 2008, is entered into in the State of California by and between the City of Chino Hills, a California general law municipal corporation, hereinafter called "City", and C. J. Construction, Inc., hereinafter called "Contractor". Amend the annual "Not-to-Exceed" amount of the agreement by $31,500 to construct additional concrete repairs: Original Agreement $100,000 Amendment No. 1 $ 23,500 Amendment No. 2 (not-to-exceed) $ 31,500 Cdhi(aCt $15$.j):00, All other provisions of the agreement remain in effect.
