Adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS ADOPTING THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM 2. Direct the City Clerk to forward a certified copy of the Resolution, with applicable attachments, to the San Bernardino Associated Governments (SANBAG). BACKGROUND/ANALYSIS: Measure I was approved by San Bernardino County voters in November 1989. It was renewed as Measure 12010-2040 in November 2004. The Measure authorizes the San Bernardino Associated Governments (SANBAG) to collect a one-half of one percent retail transaction and use tax. Revenue from the tax can only be used for transportation improvements and traffic management programs authorized in an Expenditure Plan as set forth in SANBAG Ordinance 89-1. Ordinance 89-1 requires that a multi-year Capital Improvement Plan (CIP) be adopted and updated annually. This plan, which includes FY 2010-11 through FY 2014-15, is the first plan solely under the renewed measure. SANBAG has conservatively estimated revenue for this five year period at $4,608,604. Staff is asking the City Council to adopt the amended Measure I spending plan and its corresponding resolution. REVIEW BY OTHERS: This agenda item has been reviewed by the Finance Director. Nix, Cit Engineer SN/AD/ps Attachments RESOLUTION NO. 10R- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS ADOPTING THE AMENDED FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM WHEREAS, San Bernardino County Voters approved passage of Measure I 1990-2010 in November 1989 and renewed as Measure 12010-2040 in November 2004, authorizing San Bernardino Associated Governments (SANBAG), acting as the San Bernardino County Transportation Authority, to impose a one-half of one percent retail transactions and use tax applicable in the incorporated and unincorporated territories of the County of San Bernardino; and WHEREAS, revenue from the tax can only be used for transportation improvement and traffic management programs authorized in the Expenditure Plans set forth in Ordinance No. 89-1 of the Authority; and WHEREAS, Expenditure Plans of the Ordinance require each local jurisdiction receiving revenue from the tax to expend those funds pursuant to a Capital Improvement Plan adopted by resolution of the local jurisdiction; and WHEREAS, Expenditure Plans of the Ordinance require each local jurisdiction annually adopt and update its Capital Improvement Plan; WHEREAS, Expenditure Plans for the local jurisdiction should be modified to reflect any changes occurring during the fiscal year; NOW, THEREFORE, the City Council of the City of Chino Hills, does hereby resolve, determine, find, and order as follows: SECTION 1. That the City Council hereby adopts the Amended Measure I Five- Year Capital Improvement Program, a copy of which is attached to this Resolution as Exhibit "A". SECTION 2.
