BACKGROUND/ANALYSIS: In August 2000, the City Council approved a five-year agreement with the Chino Valley Unified School District (CVUSD) to equally share the cost of a Deputy for ten months for a full-time School Resource Officer (SRO) at Ayala High School. The contract expired June 30, 2005, and was extended for another five year term on August 23, 2005. At that time, an additional SRO was added to the contract and was stationed at Chino Hills High School. The cost for two SROs for FY 10/11 is $339,525, excluding overtime. Per the agreement, the cost of the School Resource Officers for 10 months will be split between Chino Hills and CVUSD. Therefore, the total annual cost is not to exceed $339,525, or $169,762.50 per officer, excluding overtime. There is a $35,896.50 increase per officer from last year due to San Bernardino County contract negotiations. The program continues to foster strong collaboration between Chino Hills and CVUSD. Results of this effort include immediate police response, immediate resolutions of criminal activity, student/law enforcement interaction and crime prevention. The cost of the School Resource Officer may be adjusted at any time to reflect salary or fringe benefit increases that affect Chino Hills' contract with the San Bernardino County Sheriff's Department. The city is responsible for fuel and maintenance of all contract vehicles. Any fuel and maintenance costs charged to the county will be billed to the city on a quarterly invoice. 3 No replacement cost is included for donated and grant-funded vehicles. AGREEMENT BETWEEN THE CHINO VALLEY UNIFIED SCHOOL DISTRICT AND THE CITY OF CHINO HILLS FOR THE SCHOOL RESOURCE OFFICER PROGRAM This Agreement by and between the City of Chino Hills (hereinafter "CITY") and the Chino Valley Unified School District (hereinafter "DISTRICT") is effective for the 2010- 2011 school year (September 1, 2010 through June 30, 2011) and effective for a period not to exceed five years. WHEREAS, CITY and DISTRICT wish to jointly establish a School Resource Officer Program as a partnership of school, staff, and public service persons to respond to student needs within the school setting. NOW, THEREFORE, it is hereby agreed between the parties as follows: 1. Services of the School Resource Officers: The CITY shall be responsible for the day-to-day administration of the School Resource Officer Program. CITY agrees to make available sufficient information concerning the administration of the program and shall be the employer of the School Resource Officer for all purposes. There will be two Officers. One Officer will be assigned to Ayala High School campus and one to Chino Hills High School campus. Each Officer assigned a campus will be on campus in uniform during the school year and will be responsible for all law enforcement actions and liaison with that school. His/her involvement will require meeting and coordinating with school officials and school district security as well as planning for special events and sports activities. This does not, however, preclude the Officers from taking police actions, as he/she may deem necessary. The services of the two Officers will be provided between the dates of September 1, 2005 through June 30, 2006, at high schools located in the City of Chino Hills when mutually agreed upon by the DISTRICT and the CITY for approximately 40 hours per week. The actual work schedule will be contingent upon police officer contract guidelines and the time classes are taught during the school year. 1of3 2. Funding Conditions The DISTRICT agrees to pay one half of the cost of the two Officers for ten months, for an amount not to exceed $169,762.50, excluding overtime and subject to continued State Grant funding to the District. Any adjustments in cost will be set annually by amendments. All overtime will be authorized by the DISTRICT in concurrence with the CITY on a case- by-case basis and will be shared equally by both entities (50% each). The CITY shall bill the DISTRICT for its share in three equal installments. The first installment of shall be due September 30, the second installment due January 31, and the third installment due June 30. Further, as long as the City of Chino Hills contracts with the San Bernardino County Sheriff's Department for law enforcement services, the cost of the School Resource Officers may be adjusted at any time due to any salary or fringe benefit increases, which may be granted by the Board of Supervisors to the Sheriff's employees. 3. Terms of Agreement This Agreement shall remain in full force and effect until June 30, 2015. Prior to May 15th of each successive year, the DISTRICT and the CITY will issue an Addendum renewing, changing or modifying the existing contract terms. Additionally, either party may terminate this Agreement during the term by providing thirty (30) days written notice to the other party. This Agreement may be renewed, altered, or amended at any time in whole or in part by mutual written consent of both parties. 4. Indemnity: Pursuant to Government Code Section 895.4, the CITY agrees to indemnify the DISTRICT for all damages causes by any negligence or unlawful act or unlawful act or omissions by any employee or official of the CITY in the performance of this Agreement. 2 of 3 Pursuant to Government Code Section 895.4, the DISTRICT agrees to indemnify the CITY for all damages caused by any negligence or unlawful act or omissions by any employee or official of the DISTRICT in the performance of this Agreement.
