CLERK jO ”.P CHM° HILLS June 1, 2010 TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: CITY MANAGER SUBJECT: RESOLUTION FOR SUBMISSION OF USED OIL PAYMENT PROGRAM APPLICATIONS RECOMMENDATION: Adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS AUTHORIZING THE SUBMISSION OF USED OIL PAYMENT PROGRAM APPLICATIONS TO THE DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY (CALRECYCLE). BACKGROUND/ANALYSIS: The California Oil Recycling Enhancement Act, which is administered by the California Department of Resources Recycling and Recovery (CalRecycle), is a law designed to discourage the illegal disposal of used oil. This law requires oil manufacturers to pay to the Board $0.16 for each gallon of lubricating oil sold in California, Registered industrial generators, curbside collection programs, and certified collection centers are eligible to receive $0.16 for each gallon of used lubricating oil recycled. In September 2009, Governor Schwarzenegger signed Senate Bill (SB) 546 (Lowenthal) making significant changes to the California Oil Recycling Enhancement Act. The bill restructured the lubricating oil recycling fee and the used oil recycling incentive payment system, streamlined the used oil grant programs, promoted the production and use of re-refined oil, made changes to the used oil certified collection center program, and made various changes to the handling and management of used oil. These changes took effect on January 1 , 2010. In order to receive funds for its recycling programs, the City needs only to submit a completed application and meet the program's eligibility requirements. To be eligible, the City's used oil collection program must include a public education program that includes informing the public of locally available used oil opportunities, used oil collection for all residents of the jurisdiction, and have at least one certified used oil collection center within the jurisdiction. The City meets all of these requirements and is, therefore, eligible for funding. .. I ,. -, /i ; ecii,----' AGENDA DATE: JUNE 8, 2010 PAGE TWO SUBJECT: RESOLUTION FOR THE SUBMITTAL OF A USED OIL PAYMENT PROGRAM APPLICATIONS Used Oil Payment Program funds are awarded annually and have terms of two years. The term for the upcoming grant begins on July 1, 2010 and terminates on June 30, 2012. The estimated amount of the grant for Fiscal Year 2010/2011 is $10,000. The funds received will be used to continue to promote the proper handling and disposal of used oil and oil filter recycling. REVIEW BY OTHERS: This item has been reviewed by the City's Contract Compliance Officer. FISCAL IMPACT: There will not be a negative financial impact as a result of the adoption of this Resolution. WHEREAS, Public Resources Code sections 48690 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, to make payments to qualifying jurisdictions for implementation of their used oil programs as required by PRC Section 48690 et seq.: and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the Used Oil Payment Program; and WHEREAS, CalRecycle's procedures for administering the Used Oil Payment Program require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the Used Oil Payment Program. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF CHINO HILLS DOES HEREBY RESOLVE, DETERMINE, FIND, AND ORDER AS FOLLOWS: SECTION 1. That the City Council of the City of Chino Hills authorizes the submittal of a Used Oil Payment Program application to CalRecycle. SECTION 2. That the City Manager, or his/her designee, of the City of Chino Hills is hereby authorized and empowered to execute in the name of the City of Chino Hills all documents, including but not limited to, applications, agreements, annual reports including expenditure reports and amendments necessary to secure said payments to support our Used Oil Collection Program, SECTION 3. That this authorization is effective until rescinded by the City Council of the City of Chino Hills. 1 of 3 SECTION 4. The City Clerk shall certify as to the adoption of this resolution.
