06-08-2010 CC Rpt A12 PFCEI ED COUNCIL AGENDA STAFF REPORT 20I0hgi TT81i12r Meeting Date' June 8. 2010 Y CLERK CHINO HILLS Public Hearing: Ti ir^��:�r� Discussion Item; ❑ Consent Item: t� June 1, 2010 TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: CITY MANAGER SUBJECT: ACQUISTION OF MISCELLANEOUS STREET RIGHTS OF WAY FROM CALTRANS RECOMMENDATION: Authorize the California Department of Transportation (Caltrans) to begin the relinquishment process and waive the Department's obligation to provide 90 days prior notice of "Intention to Relinquish" as set forth in Section 73 of the Streets and Highway Code. BACKGROUND/ANALYSIS: During the construction of Highway 71 , Caltrans acquired the rights to various rights of way along the perimeter of the highway. With the construction complete, Caltrans has determined no further need for these rights of way and has proposed relinquishment to the City of Chino Hills. These areas are identified as follows: 1. Ramona Avenue between Highway 71 and Chino Hills Parkway 2. Frontage Road between Monte Vista and Red Barn Road 3, Pomona Rincon Road west of Soquel Canyon Parkway 4. Fairfield Ranch Road adjacent to Big League Dreams All of these streets are used for public access, contain public utilities, and are in reasonably good condition. Since these streets are currently under Caltrans authority, an encroachment permit is required for any routine maintenance performed on the utilities or streets. Acceptance of these streets into the City-maintained system will not add any significant costs to the annual operating budget and will enhance our ability to maintain our facilities. Under Section 73 of the Streets and Highway Code, Caltrans is obligated to provide 90 days prior notice to allow cities an opportunity to review the subject streets and request any repairs necessary. Staff has reviewed all the subject areas and opines that no repairs are needed. It is, therefore, recommended that the 90 day notice be waived.
