A09-89 WITH SANDOVAL PIPELINE ENGINEERING, INC. FOR CONSTRUCTION OF THE LOS SERRANOS INFRASTRUCTURE IMPROVEMENTS PHASE 1B — STORM DRAIN PROJECT RECOMMENDATION: Authorize a reduction in retention from ten percent (10%) to five percent (5%) of the total contract to Agreement No. A09-89 with Sandoval Pipeline Engineering, Inc. BACKGROUND/ANALYSIS: On December 8, 2009, the City Council awarded a contract to Sandoval Pipeline Engineering, Inc. in the amount of $671,465 for the construction of the storm drain in Valle Vista Drive from Del Node Avenue to Country Club Drive, and in Descanso Avenue from Valle Vista Drive to Sierra Vista Drive. During the course of construction, the City Council approved Change Orders 1 through 3 amending the total contract amount to $804,348.61, The construction was substantially completed on April 29, 2010, however a survey monument was disturbed during the paving operations. The contractor is required to reset the monument and file a Corner Record with the County Surveyor's office prior to the City's acceptance of the work. Since the 35-day time period necessary for release of retention cannot begin until the County Surveyor has approved the Corner Record, the contractor has requested that the retention held be reduced from 10% to 5%. Staff is not aware of any issues regarding payment to subcontractors and suppliers. REVIEW BY OTHERS: This item has been reviewed by the Finance Director and the Public Works Director.
