On February 9, 2010, the City Council adopted Resolution No. 10R-07 ordering the Engineer's Report for 2010-11 fiscal year, and setting the date of May 25, 2010 for Council review of the preliminary Engineers Report. Staff delayed the production of the preliminary report to evaluate the budget in an effort to reduce the support that the General Fund provides to the District. The approval of this resolution would extend Council review of the fiscal year 2010-11 preliminary Engineers Report until June 8, 2010, at which time Council will be asked to set a date for the public hearing to review, and set the annual assessments for the district. F eager','Ci r"1clanager John Mura, Public Works Director RESOLUTION NO. 10R- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF CHINO HILLS LOS SERRANOS LIGHTING MAINTENANCE DISTRICT, PURSUANT TO PROVISIONS OF LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ., STATE OF CALIFORNIA) EXTENDING THE DATE FOR SUBMISSION OF FISCAL YEAR 2010/11 ENGINEER'S REPORT. WHEREAS, Chino Hills Los Serranos Lighting Maintenance District has been duly formed to generally include the Chino Hills Specific area; and WHEREAS, the consolidated District was established to provide street lighting, maintenance, improvements, and other similar appurtenances; and, WHEREAS, the Landscaping and Lighting Act of 1972, Streets and Highways Code, Section 22500 et seq., provides for the annual preparation of an Engineer's Report and the confirmation and levy of assessments upon the parcels within the District(s) for the estimated expenditures to provide services; and WHEREAS, on February 9, 2010 the City Council of Chino Hills adopted Resolution No. 10R-07 ordering an Engineer's Report for annual assessments for Chino Hills Los Serranos Lighting Maintenance District, street lighting, maintenance to be prepared and presented to the City Council on May 25, 2010. NOW THEREFORE, the City Council of the City of Chino Hills, acting in its capacity as the governing body of Chino Hills Los Serranos Lighting Maintenance District does hereby resolve, determine, find, and order as follows: SECTION 1. That the presentation of the proposed report be extended from May 25, 2010 to June 8, 2010, at which time the report will be presented to the City Council at the Council Chambers of the City Hall, 14000 City Center Drive, Chino Hills at which time a fixed time and place will be determined by the City Council when and where any and all persons having any objections to the confirmation of the charges or annexations for fiscal year 2010-11, may appear before the City Council to protest such confirmation or annexations. 1 of 3 SECTION 2. The City Clerk shall certify as to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 25TH day of May 2010. W.C.
