Discussion Item: U ,/ OFFICE 0t' CITY CLERK Consent Item: CHINO HILLS March 16, 2010 TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: CITY MANAGER SUBJECT: AMENDMENT NO. 12 TO AGREEMENT NO, A02-67 WITH COMPREHENSIVE PLANNING SERVICES FOR PLANNING SERVICES RECOMMENDATION: Authorize the execution of Amendment No. 12 to Agreement No. A02-67 with Comprehensive Planning Services, changing the agreement from an annual amount of $62,000 to $111 ,200 for completion of projects identified in Exhibit "A" Scope of Services. BACKGROUND/ANALYSIS: The City originally entered into an agreement for consulting services with Ms. Joann Lombardo in 2002. Since then Ms. Lombardo has provided various planning services to the City and there have been a number of amendments to the agreement for the purposes of extensions, change in hourly rates and agreement amounts. On June 23, 2009, the City Council approved Amendment No. 11, changing the agreement to an annual amount of $62,000 and extending the agreement through June 30, 2010. Ms. Lombardo is currently providing planning support to staff and will continue the incremental update of the General Plan, which will include the completion of the following tasks in the remainder of the 2009/10 fiscal year: • Complete the Housing Element Update • Draft the Land Use Plan • Draft the Circulation Plan • Draft the General Plan Elements In response to AB 32 and SB 374, which address the reduction of greenhouse gas emissions, Ms. Lombardo will begin working with staff to develop climate action policies specific to Chino Hills. Funds have been allocated to complete these tasks but the agreement was not amended previously because staff was waiting for the funding of the Energy Efficiency and Conservation Block Grants (EECBG). � 9 Agenda Date: March 23, 2010 Page 2 SUBJECT: AMENDMENT NO. 12 TO AGREEMENT NO. A02-67 WITH COMPREHENSIVE PLANNING SERVICES FOR PLANNING SERVICES As pad of the American Recovery and Reinvestment Act of 2009, funds were allocated to Department of Energy (DOE) for local governments in the form of the EECBG Program. The purpose of the program is to create and implement strategies to reduce fossil fuel emissions, reduce total energy use and improve energy efficiency in the transportation, building, and other appropriate sectors. One of the DOE approved City projects was the Green Update of the General Plan, which allowed the use of EECBG funds for a consultant that would assist with the update, which will be Ms. Lombardo. Now that staff has a better understanding of how the EECBG Program will assist with General Plan associated cost, it has determined that a change to the annual agreement amount and Scope of Work is required. Staff is requesting that the annual agreement amount be increased from $62,000 to $111,200 and that the Scope of Work be revised. REVIEW BY AFFECTED DEPARTMENTS: The Community Development Director and the Finance Director have reviewed this item. FISCAL IMPACT: Funding for the $49,200 increase in the contract amount was appropriated in the EECBG fund at the February 23, 2010 council meeting. A02-67 FOR CONSULTING SERVICES BETWEEN THE CITY OF CHINO HILLS AND COMPREHENSIVE PLANNING SERVICES THIS AMENDMENT NO. 12 TO AGREEMENT NO. A02.67 dated June 27 2006, is entered into in the State of California by and between the City of Chino Hills, a California general law municipal corporation, hereinafter called "City," and Comprehensive Planning Services, hereinafter called "Consultant." It is hereby agreed to be amended as follows: Replace the current EXHIBIT A— SCOPE OF WORK with the attached Exhibit A — Scope of Work. Replace the current EXHIBIT B — COMPENSATION with the attached Exhibit B — Compensation, All other provisions of said Agreement shall remain unchanged and in effect. IN WITNESS WHEREOF, the City Council of the City of Chino Hills has caused this Amendment to the Agreement to be subscribed by its duly authorized officers, in Its behalf, and the said party of the second part has signed this Agreement. All Reimbursable Expenses will be billed at cost. Not to exceed amount of$111,200.
