The Planning Commission inquired about the monitoring and payment requirements imposed on the use by the Conditions of Approval as opposed to those required by the franchise agreement for the restaurant. Staff responded that the franchise agreement requires the restaurant manager to periodically walk throughout the restaurant and that Condition of Approval No. 6 requires the manager to visit and monitor the activity within the arcade area at least once every half hour. The applicant informed the Planning Commission that he felt the monitoring requirements were appropriate, but was concerned about Condition of Approval No. 4, which requires him to demonstrate that the arcade machines will comply with the accessibility requirements of the California Building Code prior to their installation. After further discussion between the applicant and staff, staff proposed a mutually acceptable amendment to Condition of Approval No. 4, which requires the demonstration of compliance to occur prior to occupancy, as the machines need to be installed to verify compliance. The Planning Commission unanimously approved the project subject to the Conditions of Approval as amended, 5-0. The new restaurant is currently under construction and will be opening for business in mid-February. The applicant proposes to operate the restaurant, and the accessory arcade, from 10:00 am to 10:00 pm Sunday through Thursday and from 10:00 am to 11:00 pm on Fridays and Saturdays. An arcade use, consisting of five (5) or more machines, is permitted in the General Commercial (C-G) zoning district subject to the approval of a Conditional Use Permit. The restaurant will operate as a buffet serving pizza, pasta, and salad. All patrons will be required to pay for the buffet as they enter the restaurant. The restaurant will be approximately 4,539 square feet in area and will provide approximately 190 seats for diners. The Conditional Use Permit is requested to allow the operation of an approximately 328-square foot arcade as an accessory use within the restaurant. The applicant intends to install approximately fifteen (15) arcade machines within the arcade area for the use of the restaurant patrons. According to the City's Development Code, an arcade means a principal commercial entertainment land use consisting of five (5) or more amusement machines located within one building or structure and operated in exchange for financial or other considerations. Per the City's Development Code in Appendix "A" Regulation of Uses by Zoning District, an arcade use is permitted within the General Commercial (C-G) zoning district subject to the approval of a Conditional Use Permit, Meeting Date: February 2, 2010 Page: 4 SUBJECT: CONDITIONAL USE PERMIT 09CUP15 —CICI'S PIZZA ARCADE ANALYSIS General Plan and Zoning Consistency The proposed project is consistent with the General Plan in that the project site is designated Commercial on the General Plan Land Use Map. Chino Hills Marketplace is zoned General Commercial (C-G), which allows the arcade use subject to the approval of a Conditional Use Permit. Therefore, the approval of Conditional Use Permit 09CUP15 to allow an arcade use within an existing shopping center in a General Commercial (C-G) zoning district, subject to the attached Conditions of Approval, is consistent with the General Plan and zoning. Arcade Operation and Monitoring The portion of the proposed 4,539-square foot restaurant that will be used as an arcade is located on the left side towards the rear of the space as you enter the restaurant from the parking area. The arcade area will be approximately 328 square feet and will include approximately fifteen (15) machines. The entrance to the arcade area is adjacent to the hallway leading to the restrooms and a large window at one end of the arcade area opens to the dining area at the front of the restaurant. Managers of CiCi's Pizza franchises are required to continually travel throughout the restaurant, including the arcade area and will monitor activity within the arcade at least once every half hour (Condition of Approval No. 6). The arcade will operate during the normal business hours for the restaurant, from 10:00 am to 10:00 pm Sunday through Thursday and from 10:00 am to 11:00 pm on Fridays and Saturdays. As all customers entering the restaurant will be required to pay for the buffet, the arcade use will provide entertainment to patrons who are dining at the restaurant and will not be the primary emphasis of the business. The arcade is located entirely within the restaurant's leased space and will not impact the adjacent tenants in the shopping center (Ml Medical Rejuvenation Center, Pot-pourri Beauty and Hair, Subway, and a dental office). The restaurant is not located within the immediate vicinity of homes or schools and will not impact the surrounding community. Condition of Approval No. 2 reserves the right of the City to further review, modify, or revoke the Conditional Use Permit in the event of changed circumstances concerning the use. Parking The project will utilize, without modification, the existing parking and circulation improvements of the Chino Hills Marketplace shopping center. The existing shopping center provides approximately 1,704 parking spaces, which includes 254 parking spaces located behind the anchor stores and multi-tenant retail buildings. Chapter 16.34 Parking and Loading indicates that the parking requirements for restaurants shall be calculated at (1) parking space per one hundred (100) square feet of gross floor area. The new 4,539-square foot CiCi's Pizza restaurant (including the arcade area) requires forty-six (46) parking spaces, which brings the total parking demand for the shopping center to 1,658. Therefore, the available parking supply is sufficient to satisfy the parking demand generated by the tenants of the shopping center, including CiCi's Pizza restaurant. As the arcade is an accessory use to the restaurant, there are no additional parking spaces required beyond those required for the restaurant as a whole. PUBLIC COMMENTS A notice of the public hearing regarding this project was mailed to property owners within a 300-foot radius of the project site on January 21, 2010, and was also published in the Chino Hills Champion on January 23, 2010. The Planning Commission of the City of Chino Hills held a duly noticed public hearing on February 2, 2010, to review and consider the staff report prepared for the project, receive public testimony, and review all correspondence received on the project. SECTION 2. The Planning Commission hereby makes the following findings on Conditional Use Permit 09CUP15, a request to allow an arcade use consisting of approximately fifteen (15) arcade games in CiCi's Pizza restaurant: 1 OF 4 A. FINDING: The proposed use is consistent with the General Plan. FACT: The General Plan identifies the Chino Hills Marketplace shopping center, where CiCi's Pizza is located, as Commercial. The subject site is a portion of the Chino Hills Marketplace shopping center, which is zoned General Commercial (C-G). The applicants are requesting a Conditional Use Permit to allow an arcade use consisting of approximately fifteen (15) arcade games. The Development Code states that any land use or business with five (5) or more amusement machines shall be considered an arcade, which is allowed within the General Commercial (C-G), subject to the approval of a Conditional Use Permit. Approval of the proposed Conditional Use Permit furthers Major Goal 3 and Focused Goal 3-1 of the General Plan of a "Diversified Economic Base", by providing "Commercial and service uses targeted to serve Chino Hills residents and shoppers from other cities". Therefore, the approval of Conditional Use Permit 09CUP15, subject to the attached Conditions of Approval is consistent with the General Plan. B. FINDING: The nature, condition, and development of adjacent uses, buildings, and structures have been considered, and that the uses will not adversely affect or be materially detrimental to these adjacent uses, building, or structures. FACT: The proposed arcade use will not adversely affect or be materially detrimental to the adjacent uses, buildings, or structures. The new CiCi's Pizza restaurant is being constructed within existing tenant spaces in the Chino Hills Marketplace shopping center. The arcade will be located entirely within and be accessory to the restaurant and will not adversely impact the surrounding tenants or the shopping center as a whole. C. FINDING: The site for the proposed conditional use is of adequate size and shape to accommodate the use and buildings proposed. FACT: The lease area for CiCi's Pizza is approximately 4,539 square feet and is located within existing tenant spaces in the shopping center. The arcade is approximately 328 square feet and is located entirely within the CiCi's Pizza restaurant. The project site is of adequate size and shape to accommodate the proposed use. D. FINDING: The proposed use complies with applicable development standards of the zoning district. FACT: The proposed use, with the Conditions of Approval as imposed, complies with all applicable development standards of the General 2 OF 4 Commercial (C-G) zoning district. The new CiCi's Pizza restaurant is located within an existing vacant tenant space in the existing Chino Hills Marketplace shopping center, which complies with the development standards of the General Commercial (C-G) zoning district, including parking requirements. E. FINDING: The proposed use observes the spirit and intent of the Development Code. FACT: With approval of Conditional Use Permit 09CUP15, the proposed use is consistent with the requirements of the General Commercial (C-G) zoning district, which allow an arcade use subject to the approval of a Conditional Use Permit. Also, the Conditions of Approval, as referenced herein, are imposed on the project to ensure that the spirit and intent of the Development Code are observed. SECTION 3. Based on the findings and conclusions set forth above, the Planning Commission hereby approves Conditional Use Permit 09CUP15 subject to the Conditions of Approval dated February, 2, 2010, and the Project Plans labeled as Exhibit "A". This Conditional Use Permit (CUP) shall become null and void if all conditions of approval have not been complied with and the Permit is not used within two (2) years of the date of approval. The Planning Commission may grant one extension of time for a period not to exceed two (2) years, provided an application requesting the extension is filed with the Planning Division no less than 30 days prior to the expiration of the Permit. "Use" as referred to in this Condition means any activity authorized by the approval. If an extension of time is not granted, the CUP shall expire and a new application shall be required. 2. The City retains and reserves the right and jurisdiction to review and modify the permit, including the conditions of approval, based on changed circumstances. Changed circumstances include, but are not limited to, the modification of the business, a change in scope, emphasis, size, or nature of the business, or the expansion, alteration, reconfiguration, or change of use. The reservation of right to review any permit granted or approved hereunder by the City, its Planning Commission, and City Council is in addition to, and not in lieu of, the right of the City, its Planning Commission, and City Council to review and revoke or modify any permit granted or approved hereunder for any violations of the conditions imposed on such permit. 3. The applicant and its successors in interest shall indemnify, protect, defend (with legal counsel reasonably acceptable to the City), and hold harmless, the City, and any agency or instrumentality thereof, and its elected and appointed officials, officers, employees, and agents from and against any and all liabilities, claims, actions, causes of action, proceedings, suits, damages, judgments, liens, levies, costs, and expenses of whatever nature, including reasonable attorney's fees and disbursements (collectively "Claims") arising out of or in any way relating this project, any discretionary approvals granted by the City related to the development of the project, or the environmental review conducted under California Environmental Quality Act, Public Resources Code Section 21000 et seq., for the project. If the City Attorney is required to enforce any conditions of approval, all costs, including attorney's fees, shall be paid for by the Applicant. Any request to expand the hours of operation beyond those stated here is subject to the review and discretion of the Community Development Director. 8. All areas within the project site shall be maintained free of trash and debris. 9. Trust Deposit Accounts shall show no deficits. 10. Prior to commencement of the approved use, all conditions of approval shall be complied with to the satisfaction of the Community Development Director. Failure to comply with any conditions of approval shall be deemed just cause for revocation of project approval by the Planning Commission.
