BACKGROUND/ANALYSIS: The Chino Hills Vellano Landscape and Lighting District was formed to provide street lighting, park, open space, landscaping maintenance, and improvements throughout the District. Annually, the City Council must hold a public hearing to review the cost of operation for Landscape and Lighting as presented in the Engineer's Report, and to set the annual assessments on properties within the District. Approval of this item will allow the Engineer's Report for fiscal year 2010/11 to proceed. The proposed report, once it has been completed will be presented to the City Council for review and approval on May 25, 2010. REVIEW BY OTHERS: The fiscal impact has been reviewed by the Finance Director and the resolution has been reviewed by the City Attorney. > � AGENDA DATE: February 9, 2010 Page 2 SUBJECT: RESOLUTION ORDERING THE ENGINEER'S REPORT FOR CHINO HILLS VELLANO LANDSCAPE AND LIGHTING DISTRICT FISCAL IMPACT: Funding for the proposed maintenance and improvement expenses will be provided by the assessment charges proposed in the Engineer's Report and will be levied against those properties receiving benefit from the services provided. Mura, PubliciWorks Director RESOLUTION NO. 10R- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF CHINO HILLS VELLANO LIGHTING AND LANDSCAPE MAINTENANCE DISTRICT, PURSUANT TO PROVISIONS OF LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ., STATE OF CALIFORNIA) ORDERING THE PREPARATION OF THE FISCAL YEAR 2010/11 ENGINEER'S REPORT WHEREAS, Chino Hills Vellano Lighting and Landscape Maintenance District (the "District") has been duly formed include the neighborhood known as Vellano; and WHEREAS, the Chino Hills Vellano Lighting and Landscape Maintenance District was established to provide street lighting, open space, park, landscaping, fencing, irrigation maintenance, improvements, and other similar appurtenances; and, WHEREAS, the Landscaping and Lighting Act of 1972, Streets and Highways Code, Section 22500 et seq., provides for the annual preparation of an Engineer's Report and the confirmation and levy of assessments upon the parcels within the District(s) for the estimated expenditures to provide services. NOW THEREFORE, the City Council of the City of Chino Hills, acting in its capacity as the governing body of Chino Hills Vellano Lighting and Landscape Maintenance does hereby resolve, determine, find, and order as follows: SECTION 1. The City staff is directed to prepare and file with the City Clerk an Engineer's Report in accordance with Article 4 (commencing with Section 22565) of Chapter 1 of Part 2 of Division 15 of the Streets and Highways Code of the State of California. SECTION 2. The improvements to the District shall include, in addition to any improvements previously authorized by District, street lighting, landscaping, open space, park, and irrigation maintenance, the addition of new capital facilities of similar nature, and any appurtenances thereto. SECTION 3. On May 25, 2010 the proposed report will be presented to the City Council at the Council Chambers of the City Hall, 14000 City Center Drive, Chino Hills, California 91709, at which time a fixed time and place will be determined by the City Council when and where any and all persons having any objections to the confirmation of the charges or annexations for fiscal year 2010/11, may appear before the City Council to protest such confirmation or annexation.
