A10-35 BETWEEN THE CITY OF CHINO HILLS AND THE CITY OF CHINO FOR THE PROVISION OF HUMAN SERVICES FOR FISCAL YEAR 2010-2011. RECOMMENDATION: Approve Amendment No. 1 to Agreement No. A10-35 with the City of Chino for the addition of the Tobacco Use Prevention Education program. BACKGROUND/ANALYSIS: On September 21, 2010, the City Council approved Agreement No. A10-35 for the provision of human services for Fiscal Year 2010-2011. Since that time, grant funding became available for the addition of a new program, the Tobacco Use Prevention Education (TUPE), focusing on preventative education for sixth grade students. Based on the receipt of grant funds, there will also be an overall reduction in the estimated contract cost by $12,833. REVIEWED BY: This item has been reviewed by the Assistant City Manager and the Finance Department. FISCAL IMPACT: Appropriations will not be decreased at this time as the contract cost is estimated and actual costs are determined by usage at the end of the year. WITNESSETH WHEREAS, the Parties entered into an agreement on July 1, 2010; and WHEREAS, the Parties wish to amend Section I and Attachments A and B of said Agreement. NOW THEREFORE, the parties agree as follows: 1. HUMAN SERVICES PROGRAM: Amend Section I "Human Services Program" to add Subsection I, Tobacco Use Prevention Education (TUPE). The Tobacco Use Prevention Education program has two components: MSPP and Project Alert. MSPP is focused on tobacco intervention education for sixth grade students at Anna Borba, Briggs, Butterfield Ranch, Cal Aero Preserve, Cattle, Chaparal, Cortez, Country Springs, Levi Dickey, Eagle Canyon, Glenmeade, Hidden Trails, Liberty, Lite!, Marshall, Newman, Oak Ridge, Rhodes, Rolling Ridge, and Wickman Elementary Schools. The program will adhere to the Minnesota Prevention Program curricula. Project Alert will include classroom presentations for seventh grade students at Briggs, Cal Aero Preserve, Canyon Hills, Magnolia, Ramona, Townsend, and Woodcrest Junior High Schools. The program will adhere to the Project Alert curricula. 2.ATTACHMENTS A AND B: Amend Attachments A and B of said Agreement to include the Tobacco Use Prevention Program (TOPE). 3. ENTIRE AGREEMENT: This First Amendment constitutes the only changes as agreed between the Parties and all other provisions of the Agreement remain unchanged and in full force. No changes of, modification of, or additions to this Agreement or this First Amendment shall be valid unless the same shall be in writing, signed by all parties hereto and made in accordance with the provisions of the Agreement. 4. COUNTERPARTS: This First Amendment may be executed in multiple identical counterparts, each of which shall be deemed an original, but all of which together will constitute one and the same instrument.
