Chino, City of A2013-48 - A1 Chino Hills Al 3-48 Contract No.: Chino 2014-102, Al Contract No.: Approved: FIRST AMENDMENT TO AGREEMENT FOR (HUMAN SERVICES PROGRAMS-FY 2013-14) THIS FIRST AMENDMENT is made and entered into this 22nd day of April 2014, by and between the CITY OF CHINO HILLS, a municipal corporation, hereinafter called "Chino Hills," and the City of Chino, a municipal corporation, hereinafter called "Chino," together referred to as "Parties." WITNESSETH WHEREAS, the Parties entered into an Agreement on July 1 , 2013, (the "Agreement"); and WHEREAS, the Parties wish to utilize Section IV of said Agreement to establish a mid-year financial adjustment by amending Section I, Human Services Programs, Subsections A and B, as well as Attachments A and B. NOW, THEREFORE, the Parties agree as follows: 1 . AMENDMENT. Through this amendment of Section 1 , Subsections A and B, and both attachments; Chino Hills and Chino agree to defund the "AIM Higher" and "Special Friends/Primary Intervention Program" (Special Friends)/"Positive Action for Life Success" (PALS) programs, and transfer these funds to the existing "Teen Counseling" and "Youth Counseling" programs. More specifically, Chino Hills agrees to exclusively transfer the funding currently provided for AIM Higher and Special Friends and PALS to Teen Counseling and Youth Counseling, as described in Attachments A and B, in order to continue providing these services within the Chino Valley Unified School District. Additionally, Attachment B outlines changes in the revenue received from the Chino Valley Unified School District for EXCEL, C.A.R.E., C.A.R.E. Case Management and TUPE, which reflect changes in the cost to Chino Hills. A\PWAGTS\PSA-AMEND.Mas\09-10-02\jg Page 1 of 3 2. ENTIRE AGREEMENT. This First Amendment constitutes the only changes as agreed between the Parties and all other provisions of the Agreement remain unchanged and in full force. No changes of, modification of, or additions to the Agreement or this First Amendment shall be valid unless the same shall be in writing, signed by all parties hereto and made in accordance with the provisions of the Agreement. 3. COUNTERPARTS. This First Amendment may be executed in multiple identical counterparts, each of which shall be deemed an original, but all of which together will constitute one and the same instrument. Authorize an appropriation increase in the amount of$12,500 from the General Fund Unreserved Fund Balance to Professional Services. 2. Approve Amendment No. 1 to Agreement No. A13-48 with the City of Chino for a modified scope of services. BACKGROUND/ANALYSIS: The City of Chino Hills provides human services programs to its residents through a contract with the City of Chino. Through the agreement, the City of Chino provides administrative supervision and oversight of the Human Services Program that targets school age children at all schools within the Chino Valley Unified School District (CVUSD). Staff at Chino Hills participating schools in the CVUSD are the primary referral agents. Each individual school has the ability to choose whether or not they would like to offer the appropriate programs to their students. Individual schools monitor the clinical staff associated with each program and the overall effectiveness of the programs through surveys of the clients. The semi-annual report containing sample surveys is attached. City staff developed the 2013/14 budget based on projected staffing costs; participation rates; and anticipated funding sources. Many of the programs provided through this agreement are funded, in part, through grants from county, state, and/or federal entities. As such, unpredicted changes are expected to require mid-year adjustments to the agreement. On August 13, 2013, the City Council approved a contract in the amount of$89,267. However, the approved contract amount was $12,500 above the 2013/14 adopted budget. AGENDA DATE: APRIL 22, 2014 Page 2 SUBJECT: HUMAN SERVICES AGREEMENT NO. A13-48, AMENDMENT NO. 1 WITH THE CITY OF CHINO FOR FY 2013-2014 The contract cost increase was a result of increased projected participation rates and City of Chino salary cost increases. Although the projected contract costs are based upon an estimate, billing is based on actual participation. Since costs were only an estimate, staff elected not to request an appropriation increase until mid-year actual costs and participation information became available. Based on the participation rates from July 1 through December 31, 2013, submitted to staff in March, it is projected that the full contract amount will be expended. The 2013/14 adopted budget was $76,800. Therefore, staff is requesting an appropriations increase in the amount of$12,500 from the General Fund Unreserved Fund Balance for the cost increase. In addition, in September 2013, staff received notification that the Chino Valley Unified School District was suspending state Medi-Cal Administrative Activity (MAA) funding until further notice. Chino staff unsuccessfully lobbied the District to restore the funding. MAA funding was used to offset the cost of Aim Higher, Special Friends/PALS, and Youth/Teen Counseling. To stay within approved contract funding levels, Chino suspended the AIM Higher and Special Friends and PALS programs to shift existing resources to the Teen/Youth Counseling programs. An amended agreement reflecting the modified scope of services is herewith submitted for City Council approval. REVIEW BY OTHERS: This item has been reviewed by the Finance Director and Contract Compliance Officer. FISCAL IMPACT: A decrease to the General Fund, Unreserved Fund Balance in the amount of $12,500.
