Chino Valley Unified School District A2010-45 - A4 E-1314-021-M 1 AMENDMENT NO. 4 TO AGREEMENT NO. A10-45 FOR THE SCHOOL RESOURCE OFFICER PROGRAM BETWEEN THE CITY OF CHINO HILLS AND THE CHINO VALLEY UNIFIED SCHOOL DISTRICT THIS AMENDMENT NO. 4 to Agreement No. A10-45, dated July 23, 2013, is entered into in the State of California by and between the City of Chino Hills, a California general law municipal corporation, hereinafter called "City", and the Chino Valley Unified School District, hereinafter called "District". Section 2 of the Agreement is amended to read as follows: The DISTRICT agrees to pay one half of the cost of the two Officers for ten months, for an amount not to exceed $190,353.50, excluding overtime and the cost of fuel and maintenance. Any adjustments in cost will be set annually by amendments, All overtime will be authorized by the DISTRICT in concurrence with the CITY on a case-by-case basis and will be shared equally by both entities (50% each). Fuel and maintenance costs will be billed on a quarterly invoice and will be shared equally by both entities (50% each). The CITY shall bill the DISTRICT for its share in three equal installments, The first installment shall be due November 30, the second installment due January 31, and the third installment due June 30. Should an officer not be provided to either school, DISTRICT shall be entitled to a credit on the next billing equal to its share of the daily cost for each officer not provided. The credit due for each officer will be calculated by dividing the DISTRICT'S annual cost of one officer by the number of days in the school year and then multiplying that result by the number of days the officer was not available. Further, as long as the City of Chino Hills contracts with the San Bernardino County Sheriff's Department for law enforcement services, the cost of the School Resource Officers may be adjusted at any time due to any salary or fringe benefit increases, which may be granted by the Board of Supervisors to the Sheriff's employees. All other provisions of the agreement remain in effect. IN WITNESS WHEREOF, the City Council of the City of Chino Hills has caused this Amendment to the School Resource Officer Program Agreement No. A10-45 to be subscribed by its duly authorized officers, in its behalf, and the said party of the second part has signed this Contract.
