A06-42 WITH MVE STUDIO, INC. FOR DESIGN OF THE GOVERNMENT CENTER PARKING STRUCTURE PROJECT RECOMMENDATION: Authorize Amendment No. 1 to Agreement No. A06-42 with MVE Studio, Inc. (MVE) for design of the Government Center Parking Structure project. 9 BACKGROUND/ANALYSIS: On May 24, 2005, the City Council authorized MVE to complete the conceptual design of the Government Center parking structure to include a residential and commercial element on the outside of the structure. On June 26, 2006, the City Council authorized MVE to begin preparation of construction documents for the structure. The initial agreement included compensation in a not-to-exceed amount of $568,620. On July 24, 2007, the City Council approved the construction documents and authorized staff to solicit bids. The project included a 144,261 square foot, 5-level structure consisting of a 419—car Type I parking structure. The lowest level of the structure would include 35 parking spaces, which may be assigned for the benefit of future adjoining residential and commercial uses. Since the original contract was awarded, several issues have resulted in changes to the original scope of work: • The original scope of work and associated fee were based upon building a shallow foundation without special pile or hydrostatic detailing. During the course of design, the soils and geotechnical investigation recommended and 18-inch pressure grouted pile design, which required additional structural design work above and beyond the initial scope of work. • • Upon bid opening, the architect was asked to evaluate cost saving alternatives that resulted in additional meeting and evaluation of engineering to potentially reduce construction costs. • Staff requested additional review and changes to landscape drawings to coincide with changes made to landscaping on the adjacent government center projects. /9 / i AGENDA DATE: JANUARY 8, 2008 PAGE TWO SUBJECT: AUTHORIZE AMENDMENT NO. 1 TO AGREEMENT NO. FOR DESIGN OF THE GOVERNMENT CENTER PARKING STRUCTURE PROJECT In a letter dated December 21, 2007, MVE provided analysis of the impact of the aforementioned changes to their existing scope and fee. Staff has reviewed this request and recommends approval of the amended scope and an increase in compensation by $56,750 for a revised not-to-exceed amount of$625,370. REVIEW BY OTHERS: This item has been reviewed by the Interim City Engineer, Finance Director, and the Assistant to the City Manager. A06-42 FOR CHINO HILLS MIXED-USE BUILDING PARKING STRUCTURE • THIS AMENDMENT NO. 1 TO AGREEMENT NO. A06-42, dated January 8, 2008, is entered into in the State of California by and between the City of Chino Hills, a California general law municipal corporation, hereinafter called "City" and MVE Studio, Inc, hereinafter called "Consultant." It is hereby agreed to be amended as follows: Amend Article II, Section D. CONSTRUCTION DOCUMENT SERVICES as follows: 7. Additional Services a. Based upon the recommendations of City's soils report (dated December 2006), Consultant's structural engineering consultant will provide additional structural construction documents which include the use of Auger Pressure Grouted (APG) piles and hydraulic slab in the foundation design versus the originally proposed foundation system. b. Consultant's structural engineering consultant will incorporate the City's pile contractor consultant's proposed Auger Pressure Grouted pile bid design basis into redesigned • structural engineering construction drawings and calculations. c. Consultant shall participate in construction cost reduction option analysis and provide additional team design engineering estimates to evaluate opportunities to reduce Project construction costs to align with City's budget requests. d. Based on additional City requested construction document revisions, including construction pricing review comments, Consultant's landscape architectural consultant will provide revised construction documents and additional City submittals beyond the two (2) submittals provided for in Consultant's landscape architectural consultant's service agreement. e. Consultant shall be compensated for these additional services in accordance with this Exhibit with a fixed fee of Fifty-Six Thousand Seven Hundred Fifty Dollars ($56,750). • f. Reimbursable expenses for these additional services will be invoiced per Article VI.B of this Exhibit and are not covered by the fee referenced in Article II.D.7.e of this Exhibit. All other provisions of said Agreement shall remain unchanged and in effect. 0 ITNESS WHEREOF, the City Manager of the City of Chino Hills has caused this Amendment o the Agreement to be subscribed by its duly authorized officers, in its behalf, and the said party of the second part has signed this Agreement.
