CM2018-037 PLNG COM ACTION RE AGENDA ITEM 7ArA City or Chino Hills DATE: June 6, 2018 MEMORANDUM CM2018-037 TO: Honorable Mayor and City Cou dI FROM: Konradt Bartlam, City Mana r RE: PLANNING COMMISSION ACTION REGARDING AGENDA ITEM 7A — CONDITIONAL USE PERMIT NO. 18CUP01 FOR ALCOHOL SALES AT HARKINS THEATER WITHIN CROSSROADS ENTERTAINMENT CENTER At their meeting on June 5, 2018, the Planning Commission (Commission) received a report from City staff regarding the above-mentioned item, a request for approval of a Conditional Use Permit amendment to allow alcohol sales within the existing Harkins Theater located at 3070 Chino Avenue, within the Crossroads Entertainment Center. The proposal includes a bar area directly to left of the concession stands and will include: a refrigerated storage area, bar counter, and a total of 20 seats for patrons. The Commission discussed the following aspects of the project with the staff and applicant: • Beverage Limits/Consumption in Auditoriums • Other Harkins Theaters selling alcohol • Details on the bar area • Security Requirements • Auditorium monitoring • Staffing • Future remodels • Spirits and Liquor sales, and • Hours of alcohol sales Staff noted that there is a limit of two alcoholic beverages that can be purchased at one time per person, but no limit in how many transactions any one person can have. Staff also confirmed that a patron can purchase an alcoholic beverage and take it into the theater for consumption. Staff indicated that Harkins Theaters are largely in Arizona, which all serve alcohol, and a total of two (2) of the five (5) Harkins Theaters which serve alcohol in California, noting that Chino Hills would be the third. Staff indicated that the bar area will have seats and a bar counter for patrons, and will have accessibility for ADA requirements. June 6, 2018 CM2018-037 Page Two Alex Verkruijsse, the Alcoholic Service Area Manager for Harkins Theaters, stated that Harkins Theater provides on-site security on the weekends which are uniformed guards that have law enforcement background. Mr. Verkruijsse indicated to the Commission that auditorium monitoring is done by multiple trained management staff every 30 minutes to monitor behavior and conduct during each movie screening. Mr. Verkruijsse also noted that each management staff member is trained for each section of the theater in order for staff rotations to occur or if additional staffing is needed for specific areas. He stated that the Chino Hills Harkins Theater will only serve beer and wine, and does not intend to sell liquor, and also explained that Harkins is evaluating future remodels which may include new layout of seats in each auditorium. The applicant, Steve Rawlings with Alcoholic Beverage Consultant, requested the hours of alcohol sales to expand from original hours of 11:00 a.m. to 11:30 p.m. to 10:00 a.m. to 12:00 a.m. to allow for special screenings for blockbusters or specific events they may have at Harkins Theaters. The Commission granted the extended hours and noted below as an amended condition of approval. There were no public comments. By unanimous vote, 5-0, the Commission adopted a resolution adopting Conditional Use Permit No. 18CUP01, subject to the modified/added conditions of approval as follows: • Modification to Condition of Approval No. 4. The project shall comply with all of the Conditions of Approval (Exhibit "A") and the project plans labeled as Exhibit "B." • Added Condition of Approval No. 4. The project shall comply with the statement of operations labeled as Exhibit "D" which is incorporated into the Conditions of Approval, by reference. • Added Condition of Approval. The project shall be in substantial conformance with Harkins Food Menu labeled as Exhibit "C" in order to comply with Alcoholic Beverage Control requirements for a bonafide eating place. • Modified Condition of Approval No. 11. The sale of beer and wine within Harkins Theater is allowed only during the following times: Sunday - Saturday 10 a.m. to 12 a.m. (midnight) KB:JL:MH:ssr
