Determine pursuant to Government Code Section 54221 that a portion of City property, Assessor Parcel Number 1023-121-12, is no longer necessary for City or other public purposes. 2. Adopt a Resolution entitled: "A Resolution of the City Council of the City of Chino Hills, Approving the Sale of Certain Surplus Real Property Abutting 12871 Fallview Court, Chino Hills to the A.W. & M.R. Jiron Family Trust, and Authorizing the Execution of an Agreement and Grant Deed therefor." Sale Price is $8,216.53. 3. Authorize the recordation of the Grant Deed and Certificate of Compliance/Notice of Merger. BACKGROUND/ANALYSIS: On October 27, 1992, City Council approved a policy for the sale of surplus property. The Surplus Open Space Policy provides a process for the sale of small, remnant parcels of open space. The intent of the Surplus Open Space Policy is to sell remnant portions of graded building pads which were not included in adjacent residential parcels and which do not enhance or contribute to the value of the adjacent natural open space areas. The homeowner enhances his/her property and the City reduces its maintenance and liability costs. Since the surplus area is generally not visible, it does not detract from the aesthetic value of the community open space. The price of these parcels has been set by this policy at the greater of $2.50 per square foot or actual cost to the City. Council deleted the Surplus Open space Sales policy at its April 26, 2005 meeting. This proposed sale was in progress at the time the policy was deleted. The parcel of land to be acquired is approximately 1,567 square feet from City Open Space Lot A of Tract 12135. The surrounding area is residential and open space. APPROVED AS RECOMMENDED fl13 'Agenda Date: May 10, 2( Page 2 SUBJECT: SURPLUS PROPERTY SALE, CITY OWNED PROPERTY ABUTTING 12871 FALLVIEW COURT, CHINO HILLS The portion of the City open space lot would be combined with the homeowner's parcel. The sale portion meets the City Council Policy on physical criteria in that it is: (1) no more than 4,000 square feet, (2) adjacent to purchaser's lot, (3) not generally visible to anyone but the purchaser or the purchaser's immediate neighbors and (4) the slope is less than 5:1 and drains into the homeowners lot, thereby protecting the adjacent open space parcel from runoff erosion. The parcel is owned in fee by the City of Chino Hills and is free of encumbrances. If the sale is approved, the homeowner has agreed to (1) construct a fence to enclose the parcel and the new fence will match the existing perimeter fencing; (2) to use the parcel for passive open space purposes only — no permanent structures, such as extensions to the residential unit or pools, will be permitted, and (3) remove any homeowner improvements to other City -owned open space areas. The purchaser's immediate neighbors were notified of the proposed sale on August 23, 2004. No response has been received. In terms of the potential "saw tooth" appearance of the perimeter fencing created by the relocation of the property owner's fence to enclose the surplus parcel, it is staffs understanding that the City Council considered this issue when the policy was adopted and decided that this was acceptable in cases such as this where the fencing was not generally visible. On October 19, 2004, the Planning Commission considered and unanimously approved the proposed sale for conformity with the City's General Plan. REVIEW BY AFFECTED DEPARTMENTS: This item has been reviewed by the Community Development Director and approved as to form by the City Attorney. FISCAL IMPACT: Revenue from the sale of this property will be deposited into the General Fund and will be used to recover the costs incurred by the City in completing the sale. Any remaining surplus revenue after expenses will be used for program overhead costs and to enhance open space areas and increase their aesthetic and/or recreational value to the community. Parcel Number 1023-121- 12 is no longer necessary for City or other public purposes; and WHEREAS, a deed and sale agreement have been prepared to convey the surplus real property to the contiguous owners the A.W. & M.R. Jiron Family Trust, at the price of $8,216.53. NOW, THEREFORE, the City Council of the City of Chino Hills does resolve, determine, find, and order as follows: SECTION 1. That this City Council hereby approves the sale of surplus real property, portion of Assessor Parcel Number 1023-121-12 to the A.W. & M.R. Jiron Family Trust, in the amount of $8,216.53, and the recordation of the deed in accordance with the terms of the sale documents. SECTION 2. That the City Council hereby authorizes the Mayor and City Clerk to execute the Agreement for the Sale of Real Property and the Grant Deed therefor, and further authorizes the recordation of the deed in accordance with the terms of the sale documents. If Buyer fails to complete said purchase as herein provided by reason of any default of Buyer, Seller shall be released from any obligation to sell the property to Buyer; in the event of such nonperformance by Buyer, Buyer agrees that the above sum of $8,216.53 shall be retained by the City of Chino Hills as liquidated damages as a direct and proximate result of said nonperformance. 5. This sale is subject to the recordation of a Certificate of Compliance and Notice of Merger merging Buyer's contiguous property. The parcel merger proceedings shall be in accordance with Article 7, Section 83.94.0701 et seq. Of the San Bernardino County Code as the same was adopted by the City of Chino Hills by City Ordinances Nos. 91-101 and 92.02. 6. Time is of the essence of this agreement. 7. This agreement is subject to approval by the City Council of the City of Chino Hills. 8. Buyer agrees to construct a fence or wall within three (3) feet of the Buyer's side of the property line of the parcel where it adjoins areas not owned by the Buyer within one year of the date of this sale. Buyer agrees that should said fence or wall not be completed within one year, that Seller may enter upon Buyer's real property and cause the same to by constructed, and that any costs thereof, including administrative costs and attorneys fees, shall constitute a lien upon Buyer's property until paid. The wall or fence shall match the existing tract perimeter fencing exactly and shall be constructed according to plans and specifications approved by Seller's Planning Department. 9. Buyer agrees to indemnify, protect, defend, and hold harmless the Seller, its officers, agents, volunteers, and employees against any and all claims arising from the Buyer's acts, omissions, or ownership of said property, and for any costs or expenses incurred by the Seller or Buyer on account of any claim therefor. 10. In the event litigation is required to be instituted by Seller against Buyer to enforce any provision hereof, Buyer agrees that should Seller prevail in such litigation, that Seller shall be entitled to all costs, expenses, and attorneys fees related to such litigation. 11. Buyer hereby expressly binds itself and its successors in interest to restrict the Property to use for open space purposes for passive use only — no permanent structures shall be permitted, but retaining walls, landscaping, irrigation, drainage facilities, shade structures, play equipment and gazebos may be permitted subject to approval of and conditions imposed by the Building and Safety Department of the Community Development Department of the City of Chino Hills.
