RE: PLANNING COMMISSION ACTION REGARDING AGENDA ITEM 7A — KIDDIE ACADEMY- CONDITIONAL USE PERMIT NO. 17CUP02 FIRST AMENDMENT At their meeting on July 16, 2019, the Planning Commission (Commission) received a report from City staff regarding the above-mentioned item, a request from Executive Development LLC to amend original approval for an existing day care center at The Rincon freeway commercial center. The amendment would expand Kiddie Academy's day care services for children up to the age of twelve (12) years old rather than a maximum age of five (5) years old. The amendment does not include an increase of capacity to the facility. Chair Voigt had general questions regarding the restroom facility within the 5-12 year old room, and Commissioner Blum had general questions regarding the vanpool vehicle parking and student capacity. Following discussion from the Commission, staff suggested to Commission to modify Condition of Approval No. 18 to clarify the maximum number of students and employees. The revised condition will read as follows: "The Day Care Center shall comply with California Department of Social Services requirements. Accordingly, the maximum age of children to be cared for at the subject location is twelve (12) years of age with a maximum capacity of 168 students and no more than 22 employees at one time, as noted on the approved plans." By vote, 3-0 (with Vice-Chair Stover and Commissioner Phan absent), the Planning Commission adopted a resolution approving Conditional Use Permit No. 17CUP02 First Amendment, subject to the revised condition of approval as noted above.
