BACKGROUND/ANALYSIS: The Chino Hills Landscape and Lighting Districts Nos. 1 and 2 were formed to provide street lighting, park, open space, landscaping maintenance, and improvements throughout the Districts. On July 28, 1992, the City Council accepted the consolidation of the two districts into a single District. Annually, the City Council must hold a public hearing to review the cost of operation for landscape and lighting as presented in the Engineer's Annual Levy Report and to set the annual assessments on properties within the District. On February 12, 2019, the City Council adopted Resolution No. 2019R-003 ordering the Engineer's Annual Levy Report for FY 2019/20. On May 28, 2019, the City Council set June 25, 2019, as the date for the public hearing. There has been no change in the annual assessments on those properties remaining in the Landscape and Lighting District. The Engineer's Annual Levy Report for FY 2019/20, with proposed assessments has been on file with the City Clerk's office since May 28, 2019. A map depicting the District Zones can be viewed on the City's Website at www.chinohills.ora/LandLDistrictsMap and is also available at the Office of the City Clerk. ENVIRONMENTAL (CEQA) REVIEW: The proposed project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Title 14 California Code of Regulations § 15301 (h) as a Class 1 Categorical Exemption (Existing Facilities). The project involves maintenance of existing landscape and lighting, and is not anticipated to have any significant impacts with regard to traffic, noise, air quality, or water quality. 258/328 FISCAL IMPACT: The proposed Fiscal Year 2019/20 budget for the District is $6,754,072 and the proposed assessments for Fiscal Year 2019/20 are projected to generate $5,162,889. The General Fund is anticipated to subsidize $1,209,338 with the remaining $381,845 to come from other income and the reserve fund. WHEREAS, on February 12, 2019, the City Council of the City of Chino Hills adopted Resolution No. 2019-003 ordering an Engineer's Report for the confirmation of annual assessments for street lighting; open space, park, landscaping, fencing, and irrigation maintenance, and other similar appurtenances along with the addition of new capital facilities and improvements of similar nature as provided in the Engineer's Report; and, WHEREAS, the City Council has been informed that the Engineer's Report described in that Resolution and setting for the proposed annual assessments for fiscal year 2019/20 is on file with the City Clerk; and WHEREAS, on May 28, 2019, the City Council set June 25, 2019, at 7:00 p.m. in the Council Chambers of City Hall, 14000 City Center Drive, Chino Hills, as the day, hour and place fixed when and where any and all persons having any objections to the confirmation of the assessments for fiscal year 2019/20 could appear before the City Council to protest such confirmation; and WHEREAS, the City Clerk did cause notice of the Public Hearing to be published in the Chino Champion, a newspaper of general circulation in the City of Chino Hills, one time, pursuant to Government Code Section 6061, not less than ten (10) days prior to the date of said Hearing; and WHEREAS, this City and its legal counsel have reviewed Proposition 218 and found that all proposed assessments comply with applicable provisions of Article XIIIC and XIIID of the California State Constitution. Page 1 of 4 260/328 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF CHINO HILLS LANDSCAPE AND LIGHTING DISTRICT NO. 1 DOES HEREBY RESOLVE, DETERMINE, FIND, AND ORDER AS FOLLOWS: SECTION 1. That the Engineer's Report which has been filed with the City Clerk for the annual assessments for the proposed Chino Hills Landscape and Lighting District No. 1 is hereby accepted. SECTION 2. That it is in the public interest and it is the intention of the City Council to confirm the assessments in the Chino Hills Landscape and Lighting District No. 1 pursuant to the Landscaping and Lighting Act of 1972, in order to provide funds to maintain the landscape and lighting improvements and construct the capital improvements as described in the Engineer's Report. The City Council may amend the report or decrease the proposed assessments set forth in the Engineer's Report. SECTION 3. That it is in the public interest and it is the intention of the City Council to order that the expense necessary for the maintenance, repairs, replacement, utilities, care, supervision, and all other items necessary for proper maintenance and operation of the improvements shall be confirmed as an assessment upon each assessable lot or parcel of land lying within the district in proportion to the estimated benefits received from the existing landscape improvements. The Engineer's Report on file with the City Clerk describes in sufficient detail the boundaries of the district and the proposed assessment on each assessable lot or parcel of land included therein. SECTION 4. That the amounts to be assessed for the expense of such maintenance and operation of the improvements shall be levied and collected in the same manner and by the same officers as taxes for the City of Chino Hills and the County of San Bernardino and levies collected shall be disbursed and expended for maintenance, operation, and service of the improvements within the district, all as described in the Engineer's Report. SECTION 5. That the capital improvements described in the Engineer's Report shall be funded as disclosed in said report and that these funds may be accumulated over a five (5) year period and the proposed improvements shall be placed on a project priority list and completed as sufficient funds accrue and upon approval by the City Council. SECTION 6. The City Clerk is hereby ordered to certify to the passage of this Resolution and to forward a copy of the same to each of the following public bodies and officers: (a) The Auditor -Controller of the County of San Bernardino; (b) The Tax Collector of the County of San Bernardino; (c) The Director of Finance of the City of Chino Hills. INTRODUCTION The City of Chino Hills ("City") annually levies and collects special assessments in order to maintain the improvements that provide a special benefit to properties within the Chino Hills Landscape and Lighting District No. 1 ("District"). The County of San Bernardino transferred the District to the City in 1991. The District is levied annually pursuant to the Landscape and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code ("the 1972 Act"). The Engineer's Annual Levy Report ("Report") describes the District, any changes to the District, and the proposed assessments for Fiscal Year 2019/2020. The assessments are based on the historical and estimated cost to maintain the improvements that provide a direct and special benefit to properties within the District. The improvements within the District and the corresponding costs, including expenditures, deficits, surpluses, revenues, and reserves, are budgeted and assessed for each distinct benefit Zone ("Zones"). For the purposes of this Report, the word "parcel" refers to an individual property assigned its own Assessment Number by the San Bernardino County Assessor's Office. The San Bernardino County Auditor/Controller uses Assessment Numbers and specific Fund Numbers to identify properties assessed for special district benefit assessments on the tax roll. Following consideration of public comments and written protests at a noticed public hearing and review of the Report, the City Council may order amendments to the Report or confirm the Report as submitted. Following final approval of the Report and confirmation of the assessments, the Council may, by resolution, order the levy and collection of assessments for Fiscal Year 2019/2020 pursuant to the 1972 Act. In such case, the assessments approved will be submitted to the County Auditor/Controller and included on the property tax roll for each parcel in Fiscal Year 2019/2020. B. COMPLIANCE WITH CURRENT LEGISLATION On November 5, 1996, California voters approved the Right to Vote on Taxes Act ("Proposition 218") by a margin of 56.5% to 43.5%. The provisions of the Proposition 218, now California Constitutional Articles XIIIC and XIIID, can be summarized in four general areas: • Strengthens the general and special tax provisions of Proposition 13 and Proposition 62. • Extends the initiative process to local taxes, assessments, fees, and charges. • Adds substantive and procedural requirements to assessments. 2019/2020 City of Chino Hills Landscape and Lighting District No. 1 Page 1 of 12 267/328 WWI LLDAN • Adds substantive and procedural requirements to property -related fees and charges. The assessments contained in this report were imposed in accordance with voter approval pursuant to the City's 1991 incorporation vote and/or a consent and waiver as part of the original development approval for the properties within the District. This process is considered the same as a petition. As such, the City has determined that the existing assessments are exempt from the substantive and procedural requirements of Article XIIID of the California Constitution ("Article XIIID"). However, any new or increased assessments above the Maximum Assessment Rates previously approved and levied by City Council will be subject to the requirements of Article XIIID. DESCRIPTION OF THE DISTRICT A. GENERAL IMPROVEMENTS AND SERVICES WITHIN THE DISTRICT Landscape and lighting improvements provided in the District includes turf, ground cover, shrubs, trees, fencing, irrigation systems, lighting, entry monuments, drainage systems, park facilities, open space, and associated appurtenances. These improvements include: necessary service; operations; administration; and maintenance required to keep the above mentioned improvements in a healthy, vigorous, and satisfactory condition, including weed abatement and prescribed burns which minimize the threat of fire in the open space areas. The costs of the improvements associated with each Zone are collected through annual assessments for each benefiting parcel. The funds collected for each Zone are dispersed and used for only the services and operations for which the properties are assessed. The costs of maintaining open space areas, community parks and certain arterial improvements are budgeted separately. Parcels benefiting from these improvements share proportionately in the costs associated with these improvements. It has been determined that specific parks within the District, Chino Hills Community Park (Eucalyptus at Peyton Drive), English Springs Park (Grand Avenue at Chino Hills Parkway), Veterans Park (Chino Hills Parkway and Eucalyptus Avenue), and Crossroads Park (Chino Hills Parkway and Carbon Canyon Road), provide a special benefit to the properties within the District. Each Zone is allocated a proportionate share of the cost of the maintenance and operations of the parks based on their special benefit. Similarly, the District is maintaining open space that provides a special benefit to the properties within the District. Each zone is allocated a proportionate share of the cost of the maintenance of the open space based on their special benefit. Within the District there are specific arterial improvements that benefit properties in various Zones. However, unlike the parks and open space that benefits the properties within the District, various arterial improvements provide special benefit to only certain Zones. The major arterial roadways are separated into three (3) areas of improvement: Los Ranchos, Woodview, and Carbon Canyon. The costs for arterial improvements in each area are assessed proportionately to the Zones that receive benefit from the arterial improvements. The Zones that receive benefit from the arterial roadways are Zone 1-C, Zone 1HD, Zone 1-1, Zone 1-K, Zone 1-N, Zone 1-P and Zone 1-T. The improvements maintained by the District include: ground cover, turf, shrubs, trees, fences, irrigation systems, multi -use trails, street lighting, and monuments along the arterial roadways. 2019/2020 City of Chino Hills Landscape and Lighting District No. 1 Page 3 of 12 269/328 Wwi LLDAN B. IMPROVEMENTS AUTHORIZED BY THE 1972 ACT As applicable or may be applicable to this proposed District, the 1972 Act defines improvements to mean one or any combination of the following: • The installation or planting of landscaping. • The installation or construction of statuary, fountains, and other ornamental structures and facilities. • The installation or construction of public lighting facilities. • The installation or construction of any facilities which are appurtenant to any of the foregoing or which are necessary or convenient for the maintenance or servicing thereof, including, but not limited to, grading, clearing, removal of debris, the installation or construction of curbs, gutters, walls, sidewalks, or paving, or water, irrigation, drainage, or electrical facilities. • The maintenance or servicing, or both, of any of the foregoing. • The acquisition of any existing improvement otherwise authorized pursuant to this section. Incidental expenses associated with the improvements including, but not limited to: • The cost of preparation of the report, including plans, specifications, estimates, diagram, and assessment; • The costs of printing, advertising, and the publishing, posting and mailing of notices; • Compensation payable to the County for collection of assessments; • Compensation of any engineer or attorney employed to render services; • Any other expenses incidental to the construction, installation, or maintenance and servicing of the improvements; • Any expenses incidental to the issuance of bonds or notes pursuant to Section 22662.5. • Costs associated with any elections held for the approval of a new or increased assessment. The 1972 Act defines "maintain" or "maintenance" to mean furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing of any improvement, including: 2019/2020 City of Chino Hills Landscape and Lighting District No. 1 Page 4 of 12 270/328 N4te WILLDAN • Repair, removal, or replacement of all or any part of any improvement. • Providing for the life, growth, health, and beauty of landscaping, including cultivation, irrigation, utilities, trimming, spraying, fertilizing, or treating for disease or injury. • The removal of trimmings, rubbish, debris, and other solid waste. • The cleaning, sandblasting, and painting of walls and other improvements to remove or cover graffiti. C. DISTRICT ZONES AND SPECIFIC AREAS OF IMPROVEMENT The local improvements that are Zone specific are included in the Services and Supplies section of the budget. The following describes those Zone specific improvements in more detail. Each Zone receives benefit from Park Maintenance, Open Space Maintenance, and additional services as listed below. Zone 1-A - This Zone is located within the development area originally known as Rolling Ridge. The Zone is generally bounded by Highway 71 to the east, Grand Avenue to the south, the City Boundary to the north and the City Boundary to the west. These parcels also receive benefit from improvements including landscaping, irrigation systems, fencing, trails and monuments. Landscaping consists of woody shrubs, mature ground cover, mature trees, turf, and ornamental shrubs. The District maintains numerous rear and side yard slopes as well as landscaping along the Peyton Drive arterial roadway within the Zone, which does not border any other Zone. The Zone has two existing passive or neighborhood parks: Calle San Marcos and Skyview. Zone 1-B - This Zone is located within the development area known as Green Valley and is generally located south of Chino Hills Parkway, west of Peyton Drive, north of Valle Vista, and east of Carbon Canyon. These parcels also receive benefit from improvements consisting of ground cover, turf, shrubs, trees, and irrigation systems. The Zone has a minimal number of sizable slopes as compared with other Zones. The Zone has a single park known as Morningside. Zone 1-C - (Commercial Property) - This Zone consists of developed and vacant commercial properties. This Zone does not have a contiguous boundary. There are commercial properties along the west side of Highway 71, the north and south corners of Chino Hills Parkway and Grand Ave, the northeast and southwest corners of Grand and Peyton, the east and west sides of Pipeline north of Chino Hills Parkway and south of Highway 71, the western corner of Eucalyptus & Chino Hills Parkway, and The Zone does not maintain any local improvements. Zone 1-HD — This Zone consists of parcels within the development areas known as Oaks and the majority of Los Ranchos. This Zone does not have a contiguous boundary, and is generally west of Peyton and includes housing tracts along Chino Hills Parkway, 2019/2020 City of Chino Hills Landscape and Lighting District No. 1 Page 5 of 12 271/328 NAte WILLDAN Eucalyptus and Peyton. In Fiscal Year 1995/1996, Zones 1-H and 1-D were consolidated into Zone 1-HD. These parcels also receive benefit from landscaping, irrigation systems, fencing, multi -use trails, and monuments. Landscaping includes ground cover, woody shrubs, ornamental shrubs, turf, and numerous new and older trees. The Zone has a variety of landscaped slopes, both gradual and steep, and are located behind and adjacent to tract developments. The Zone contains nine (9) passive or neighborhood parks: Valle Vista, Oakridge, Hope for the Hills, Sycamore Glen, Autumn Hill, Hidden Hills, Terrace, Walnut Creek, and Sunset Park. The Zone contains arterial landscaping along Peyton Drive, Grand Avenue, and Chino Hills Parkway. Zone 1-1— This Zone consists of parcels within a portion of the development area known as Los Ranchos whose improvements are located adjacent to tract developments. The Zone is generally located south of Grand Avenue, east of Madruga Drive, west of Peyton Avenue and north of English Road. The Zone does not maintain any local improvements. Zone 1-K — This Zone consists of the parcels within the development area known as Woodview. This zone of non-contiguous parcels is generally located east of Peyton Avenue, south of Boys Republic Drive and north of Village Drive. This Zone also receives benefit from local street lighting. Zone 1-MD — This Zone consists of parcels within the development areas known as Butterfield Ranch and Rincon. This non-contiguous Zone is generally located west of Highway 71 and includes housing tracts along Soquel Canyon Road and Butterfield Ranch Road. In Fiscal Year 1997/1998, Zones 1-D and 1-M were consolidated into Zone 1-MD. This consolidated Zone includes the developments known as Mountain View, Alterra, Rincon, and Butterfield Ranch. Parcels in this zone also receive benefit from improvements including fencing, monuments, multi -use trails, woody shrubs, ornamental shrubs, turf, irrigation systems, and numerous trees. Slope improvements located adjacent to tract developments within the Zone are smaller compared to other Zones. The Zone has seven (7) passive parks: Butterfield, Meadows, Hunter's Hill, Alterra, Mystic Canyon, Rincon Park and Torrey Pines. The Zone contains arterial landscaping along Butterfield Road, Soquel Canyon. Zone 1-N — This zone consists of parcels located along Esquilime Drive. This Zone also receives benefit from local street lighting. Zone 1-P — This Zone consists of the parcels located in the Carriage Hills development within the Carbon Canyon Area. The Zone is bounded by Carbon Canyon Road to the north, Old Carbon Canyon Road to the east, and Fairway Drive to the west. These parcels also receive benefit from improvements including native grasses, shrubs, trees, and irrigation systems. The large slopes maintained in the Zone are located along roadways, adjacent to tract developments. There are no existing or currently planned parks, and no arterial landscaping within the Zone. 2019/2020 City of Chino Hills Landscape and Lighting District No. 1 Page 6 of 12 272/328 WWI LLDAN Zone 1-T - This Zone generally located north of Carbon Canyon, south of Eucalyptus, and on the east and west side of the Western Hills Country Club. The Zone does not maintain any local improvements. ///. CHANGES TO THE DISTRICT There have been no changes in the properties or improvements in the District for Fiscal Year 2019/2020. /V METHOD OF APPORTIONMENT Pursuant to the 1972 Act, the costs of the District may be apportioned by any formula or method that fairly distributes the net amount to be assessed among the assessable parcels in proportion to the estimated special benefits to be received by each parcel from the improvements. The following formula is used to arrive at a levy amount for parcels in each Zone: Each parcel is assigned a weighting factor known as a Benefit Unit Factor ("BUF") based on its land use. The parcel's BUF, multiplied by its acres or units, determines the parcel's Equivalent Benefit Unit ("EBU"). The following table describes the Land Use categories and Benefit Unit Factors assigned. DESCRIPTION OF BUDGET ITEMS The following describes the services and costs that are funded through the District shown in the District Budgets. Services and Supplies - Includes contracted labor, material, utilities, and equipment required to properly maintain the improvements specific to that Zone. The Zone improvements may include, but are not limited to: neighborhood and passive parks, turf, ground cover, shrubs, trees, irrigation systems, lighting, entry monuments, drainage systems, open space and associated appurtenances. Capital Outlay - The Capital Outlay are funds used to pay for planned replacements or improvements during the fiscal year or future years. Open Space - Includes each benefiting Zone's prorata share of the costs specific to the maintenance of open space. There are approximately 3,350 acres of open space set aside for the use and enjoyment of the residents and property owners within the District. Park Maintenance - Includes each benefiting Zone's prorata share of the costs specific to the maintenance of the Chino Hills Community Park (Peyton Drive at Grand Avenue at Chino Hills Parkway), English Springs Park (Grand Avenue at Chino Hills Parkway), Veterans Park (Chino Hills Parkway and Eucalyptus Avenue), and Crossroads Park (Chino Hills Parkway and Carbon Canyon Road). Arterial Maintenance - Includes each benefiting Zone's prorata share of the arterial maintenance costs. The City is divided into distinct neighborhoods, and properties within these areas have been determined to benefit from arterial maintenance within their Zone. Funds are allocated to the Arterial Maintenance Fund when one or more Zones share an arterial. Each zone is then responsible for their pro-rata share of the maintenance. Administrative Costs - This includes any overhead that is needed to annually administer the District. 2019/2020 City of Chino Hills Landscape and Lighting District No. 1 Page 8 of 12 274/328 WWI LLDAN Capital Improvement Program (CIP) - Includes costs of capital projects designated for each Zone. Capital Improvement Program items include re -landscaping, retrofit/ replacement of irrigation systems, and the replacement of park amenities. Other Revenue Sources - Additional funds designated for use by the District that are not District assessments. These funds are added to the District account and may be from either non -District or District sources. General Fund Support - Contribution from the general fund. Reserve Collection/ (Contribution) — Includes funds being set aside specifically to provide a cash flow reserve. This Reserve is used to retain an adequate amount of funds to meet the required expenditures for the District from the period of July 1 (the beginning of the Fiscal Year) through December. Each December, the County provides the City with the first installment of assessments collected from the property tax bills. The Reserve eliminates the need for the City to transfer funds from non -District accounts to pay for District charges during this first half of the fiscal year. Balance to Levy - This is the total amount to be levied to the parcels within the District. The Balance to Levy represents the total direct and administration costs, plus any reserve collection, minus any beginning balance, City contribution or other reserve sources. This dollar amount represents the funds that are to be collected for that Fiscal Year from the property owners. Total Equivalent Benefit Unit (EBU) - The Equivalent Benefit Unit (EBU) is a numeric value calculated for each parcel based on the parcel's land use and size as compared to a single family residence. The EBU shown in the District budgets represents the sum total of the parcel EBU's that receive benefit from the improvements. Levy per EBU - is the amount levied for each Equivalent Benefit Unit (EBU) for the current fiscal year. The Boundary Maps are available for inspection on-line at www.chinohills.orq/LandLDistrictsMap and are also available at the Office of the City Clerk during normal business hours. 2019/2020 City of Chino Hills Landscape and Lighting District No. 1 Page 11 of 12 277/328 WWI APPENDIX B — 2019/2020 COLLECTION ROLL Parcel identification, for each lot or parcel within the District, shall be the parcel as shown on the San Bernardino County Assessor Parcel Maps and/or the San Bernardino County Secured Tax Roll for the year in which this Report is prepared. Non -assessable lots or parcels may include government owned land, public utility owned property, and land principally encumbered with public right-of-ways or easements and dedicated common areas. These parcels will not be assessed. A listing of parcels within the District and Zones, along with the proposed assessment amounts, will be submitted to the City Clerk and by reference, are made part of the final Report. Upon approval of the Engineer's Annual Levy Report and confirmation of the assessments, the assessment information will be submitted to the County Auditor/Controller, and included on the property tax roll in Fiscal Year 2019/2020. If the parcels or assessment numbers within the District and referenced in this Report are re- numbered, re -apportioned or changed by the County Assessor's Office after approval of the Report, the new parcel or assessment numbers with the appropriate assessment amount will be submitted to the County Auditor/Controller.
