06-25-2019 CC Rpt 15COUNCIL AGENDA STAFF REPORT Chino I IiEI� TO: HONORABLE MAYOR AND CITY COUNCIL DATE: JUNE 25, 2019 MEMBERS FROM: CITY MANAGER ITEM NO:15 SUBJECT:AMENDING THE MASTER SCHEDULE OF FEES, FINES AND PENALTIES RECOMMENDATION: Adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, CALIFORNIA, AMENDING THE MASTER SCHEDULE OF FEES, FINES AND PENALTIES SET FORTH IN RESOLUTION NO. 2019R-036 BY ADDING CERTAIN COMMUNITY SERVICES AND BUILDING FEES, AND DETERMINING THAT THE ADOPTION OF THE FEES, FINES AND PENALTIES ARE EXEMPT FROM REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. BACKGROUND/ANALYSIS: On June 11, 2019, the City Council held a public hearing and reviewed the Master Schedule of Fees, Fines and Penalties (Fee Schedule) update. The Fee Schedule establishes the City's authority to charge fines and penalties for violations of law. It also sets fees to recover the reasonable cost for services provided by the City to individual beneficiaries. Fees generally represent the full staff costs of providing the service. However, a fee can be reduced, or subsidized, to incentivize participation or respond to market factors. The majority of the Fee Schedule was approved and adopted on June 11, 2019. However, the City Council asked that a few fees be brought back for further discussion. Currently, if a non-profit organization reserves a facility, like the Community Center, McCoy Equestrian Center, Community Park, or Grand Avenue Park, they must submit a Facility Use Application. If the event does not affect areas outside the facilities' boundaries, including on -site parking, there is no additional charge to the requesting non-profit group, due to that group already having to pay facility use fees. However, if a reservation requires additional staff review/attention, due to greater than normal logistics, that group would need to fill out a Special Event Application because there is another level of evaluation that could take place that may include Chino Hills Police Department and or Chino Valley Fire District. The processing of a Special Event Permit would then cost a non-profit group a proposed $232 fee charged by the Community Services Department. If the event requires attention by the Community Development Department's Planning Technician I, due to an impact on streets including parking or closures, the organization would be charged by the Community Development Department only. Note: If both Community Services and Community Development are involved in reviewing the special event, only one department will charge the group. Insurance Processina Fee The proposed Insurance Processing Fee is to recoup a portion of staff costs related to time spent processing requests for insurance coverage either for a facility rental or for contract instructors. Alliant, a third -party insurance provider that is affiliated with the City's insurance pool (California Joint Powers Insurance Authority), allows the City to process liability coverage for third party individuals that do not already have their own insurance. Often times, the cost through Alliant is lower than other insurance providers. As a convenience, the City started to offer this additional service to customers and instructors, but it does require additional processing time by staff. Alliant does not allow third party individuals to submit insurance inquiries on their own; therefore, staff needs to work as the liaison between the two parties. Staff needs to submit the request to Alliant, relay the information to the customer, and coordinate payment from the customer to the City, and then from the City to Alliant. On a quarterly basis, staff needs to submit a reconciliation to Alliant to ensure that all payments were processed. On average, the amount of staff time spent processing one request is about two hours. This process is completely handled by full-time staff. Based on the fully -burdened hourly rate, the full cost is $418.59. Staff has proposed a reduced fee of $50. Buildina Carnival & Circus Fees The Carnival & Circus fees have been on the City's Community Development Department fee schedule for many years. However in practice, the Building Division has used the miscellaneous inspection fee for the annual carnivals and the recent circus. The miscellaneous inspection fee is charged based on the Department's hourly rate, which is 192/328 $232 for fiscal year 2019-2020. Winston Ward, the City Building Official, says that carnivals and circuses have a variety of mechanical, electrical and structural elements that require a building inspector's review. Depending on the size and complexity of the carnival or circus, the inspection can be completed within one or a few hours, which is why the miscellaneous inspection fee has been used rather than the specific Carnival & Circus fees. In the case of St. Paul's annual harvest festival, the typical Building Division inspection fee has been a one -hour charge. Staff contacted six nearby cities to obtain their typical carnival & circus building inspection fees. Each city charges these fees as a bundle tied to other special event fees, so it was difficult to obtain a direct comparison. None of the other cities offered a fee waiver or reduction for non-profit carnivals or circuses. Because the miscellaneous inspection fee has proven a more reasonable method for reviewing carnivals and circuses, staff proposes that the above listed Carnival & Circus fees be deleted from the schedule. The average building inspection fee charged for non- profit special events is one and a half hour with a full cost of $348. Staff proposes that a new Building Services Non -Profit Special Events fee be created and that it be set at one hour of staff time or $232. It is recommended that the Building fees and Development Services fees, as well as the Engineering fees that are listed under "Entitlement" and "Post -Entitlement" subheadings under consideration in the proposed resolution, be effective September 1, 2019, and all other fees, fines and penalties be effective July 1, 2019. This will enable staff sufficient time to update forms, applications, and computer software as necessary for the implementation of the fees. 193/328 ENVIRONMENTAL (CEQA) REVIEW: These proposed actions are exempt from review under the CEQA (Cal. Pub. Res. Code § 21000, et seq.; "CEQA") and CEQA regulations (Cal. Code Regs. Tit. § 15000, et. seq.) because they establish, modify, structure, restructure, and approve rates and charges for meeting operating expenses; purchasing supplies, equipment, and materials; meeting financial requirement; and obtaining funds for capital projects needed to maintain services within existing service areas, so it is statutorily exempt from further CEQA review under Cal. Code Reg. Tit. 14, § 15273. Further, these actions do not constitute a "project" that requires environmental review because they are fiscal activities that do not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitute an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. (See specifically 14 CCR § 15378(b)(4-5)). FISCAL IMPACT: Approval of the resolution amending the Master Schedule of Fees, Fines & Penalties will increase revenues as applicable. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHINO HILLS, DOES RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. Fee Schedule. The revised Master Schedule of Fees, Fines and Penalties is hereby adopted as set forth in Exhibit "A" attached to this resolution. SECTION 2. Fines. The fee schedule, in addition to fees, includes fines and penalties for violation of local and state law. SECTION 3. Reasonable Cost Finding. The City Council specifically finds that based on the data made available to the public, the fees adopted do not exceed the reasonable cost of service provided. SECTION 4. Repealer. Fees contained in this resolution supersede fees set by prior resolutions. Current fees set by prior resolutions, which are not changed by Exhibit "A", remain in place. SECTION 5. Severability. If any portion of this resolution is found to be unconstitutional or invalid, the City Council hereby declares that it would have enacted the remainder of this resolution regardless of the absence of any such invalid part. SECTION 6. CEQA. This Resolution is exempt from review under the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000, et seq.; "CEQA") and CEQA regulations (Cal. Code Regs. tit. 14, §§ 15000, et seq.) because it establishes, modifies, structures, restructures, and approves rates and charges for meeting operating expenses including employee wage rates and benefits, purchasing supplies, equipment, and materials, meeting financial requirements, and obtaining funds for capital projects needed to maintain service within existing service areas. This Resolution, therefore, is categorically exempt from further CEQA review under Cal. Code Regs. tit. 14, § 15273. SECTION 7. Adoption. The City Clerk shall certify as to the adoption of this resolution. 2 of 4 196/328 SECTION 8. Effective Date. The Building fees and Development Services fees as well as the Engineering fees that are listed under "Entitlement" and "Post - Entitlement" subheadings under consideration in the proposed resolution, will become effective September 1, 2019, which is no earlier than sixty (60) days after adoption as required by Government Code §66017 for certain User Fees, and all other fees, fines and penalties will be effective July 1, 2019, and will remain in effect unless repealed or superseded.
