12-11-2018 CC Rpt 24COUNCIL AGENDA STAFF REPORTCOUNCIL AGENDA STAFF REPORT TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS DATE: DECEMBER 11, 2018 FROM: CITY MANAGER ITEM NO:24 SUBJECT:NOTICE OF COMPLETION FOR THE LOS SERRANOS INFRASTRUCTURE IMPROVEMENTS - ACTIVE TRANSPORTATION PROGRAM (ATP) CYCLE 1 PROJECT BY LOS ANGELES ENGINEERING, INC. RECOMMENDATION: 1. Accept the Los Serranos Infrastructure Improvements - Active Transportation Program (ATP) Cycle 1 Project By Los Angeles Engineering, Inc. as complete. 2. Authorize the City Clerk to cause the Notice of Completion to be recorded. 3. Authorize the release of retention monies in the amount of $96,954.81, forty-five days after acceptance of the work by the City Council. 4. Authorize the release of any remaining encumbrance after final payment of retention. 5. Reduce the amount of the Performance Bond to 15% for warranty purposes for a period of one year. 6. Authorize the release of the Labor and Materials Bond seven months after project acceptance. BACKGROUND/ANALYSIS: On December 12, 2017, the City Council awarded a contract to Los Angeles Engineering, Inc. in the amount of $1,936,775.00 for the Los Serranos Infrastructure Improvements - ATP Cycle 1 Project. The Council also provided authorization for the City Manager to approve change orders up to a cumulative amount of $193,677.50 or 10% of the contract amount. Construction began on February 20, 2018, and was substantially completed on September 21, 2018. Due to unforeseen field conditions, some material quantities and their associated labor needed to be adjusted. On October 25, 2018, Change Order No. 1 was approved by the City Manager in the amount of $2,321.28. The original contract amount of $1,936,775.00 was subsequently increased to $1,939,096.28, representing a 0.12% increase to the original contract amount. All work has been completed satisfactorily, and staff recommends the Notice of Completion be filed with the County Recorder's office. ENVIRONMENTAL (CEQA) REVIEW: At the February 14, 2017, City Council meeting, the project was determined to be exempt as a Class 1(c) Categorical Exemption (existing highways and street, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities), pursuant to Section 15301 of Guidelines for the California Environmental Quality Act of 1970, as amended, Public Resources Code section 21000 et seq. City staff has also determined that the project is exempt as a Class 2 Categorical Exemption, (existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities), pursuant to Section 15302 of Guidelines for the California Environmental Quality Act of 1970, as amended, Public Resources Code section 21000 et seq. 213/296 FISCAL IMPACT: Funds for the Los Serranos Infrastructure Improvements - ATP project were previously approved by the City Council as part of the Fiscal Year 2018-19 Capital Improvement Program (CIP) budget.
