12-11-2018 CC Rpt 08COUNCIL AGENDA STAFF REPORTCOUNCIL AGENDA STAFF REPORT TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS DATE: DECEMBER 11, 2018 FROM: CITY CLERK ITEM NO:8 SUBJECT:DECLARATION OF THE RESULT OF THE GENERAL MUNICIPAL ELECTION HELD NOVEMBER 6, 2018 RECOMMENDATION: Adopt the following resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 6, 2018, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW. BACKGROUND/ANALYSIS: A General Municipal Election to elect three City Council Members for Districts 1, 2, and 4 for full four-year terms was held on November 6, 2018. In accordance with Section 10263 of the Elections Code, the City Council is required to adopt a resolution declaring the results of the City's General Municipal Election. The proposed resolution must recite the number of total ballots cast in the City and the number of votes cast for each candidate, as canvassed and certified by the Registrar of Voters. The canvass indicates that Ray Marquez, Peter Rogers, and Brian Johsz were elected as Members of the City Council for Districts 1, 2, and 4, respectively, for terms ending in November 2022. The proposed resolution contains the whole number of ballots cast in the City, the names of the persons voted for, for what office each person was voted for, the number of votes given in each precinct to each person: and the total number of votes given to each person. FISCAL IMPACT: Funds to cover costs associated with conducting the General Municipal Election in the amount of $62,150 were approved with the 2018-19 budget. WHEREAS, a General Municipal Election was held and conducted in the City of Chino Hills,California, on Tuesday,November 6 , 2018, as required by law; and WHEREAS,Notice of the Election was given in time, form and manner as provided by law;that voting precincts were properly established;that election officers were appointed, and that in all respects the election was held and conducted and the votes were cast, received and canvassed, and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS,pursuant to Resolution No.2018R-24 adopted on June 12, 2018, the San Bernardino County Election Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached, and made a part hereof as "Exhibit A". NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF CHINO HILLS DOES RESOLVE,DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots cast in the precincts, including vote-by-mail voter ballots and provisional ballots are detailed in the Official Canvas attached as Exhibit A and incorporated into this Resolution by this reference. SECTION 2. That the names of persons voted for and the numbers of votes received at the election for Member of the City Council are as follows: DISTRICT 1 Ray Marquez 3,832 DISTRICT 2 Peter J. Rogers 3,972 DISTRICT 4 Brian Johsz 1,924 Gabriel U. DeLuna 890 Rossana Mitchell-Arrieta 1,100 Ronald K. Eaton 136 SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective 8/296 2 of 3 offices for which the persons were candidates were as listed in "Exhibit A" attached. SECTION 4. That the City Council does hereby declare and determine that Ray Marquez was elected as Member of the City Council for District 1, Peter Rogers was elected as Member of the City Council for District 2, and Brian Johsz was elected as Member of the City Council for District 4 for terms ending in November 2022. SECTION 5. The City Clerk shall enter on the records of the City Council of the City of Chino Hills, a statement of the result of the Election showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for: (3) For what office each person was voted for; (4) the number of votes given at each precinct to each person; and (5) The total number of votes given to each person. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. 9/296 3 of 3 SECTION 7.
