FOR PARK LAND, ACCESS AND WATER LINE EASEMENTS, ACCEPTANCE OF FAIRWAY DRIVE INTO THE CITY MAINTAINED STREET SYSTEM, DRAINAGE AND STREET IMPROVEMENTS ON FAIRWAY DRIVE, AND PARKING LOT IMPROVEMENTS RECOMMENDATION: It is recommended that the City Council authorize approval of an agreement between the City of Chino Hills and Western Hills Golf Association, Ltd. (WHGA) for conveyance of park land and easements to the City, acceptance of Fairway Drive into the City maintained street system, drainage and street improvements on Fairway Drive, and parking lot improvements. BACKGROUND/ANALYSIS: Western Hills Golf Course in Carbon Canyon is located between Carbon Canyon Road and Eucalyptus Avenue. The City has a need to establish an emergency access road that would connect Canon Lane to Eucalyptus Avenue for public safety services. In order to construct such an access road, it is necessary to cross the golf course. Securing an easement from Western Hills will help allow for the eventual emergency road. Additional easements will be needed from an adjacent property owner to implement the emergency road. The exact location and design of the access road will be subject to reasonable review and approval by Western Hills. Additionally, City water lines are located on the golf course without benefit of dedicated easements. This agreement allows for the granting of easements where water lines currently exist. For many years, excess water has caused extensive damage to Fairway Drive and the golf course parking lot. Although initially thought to be ground water, after exhaustive engineering review, it was determined that the water is drainage from the Carriage Hills development. The development that is located across Carbon Canyon Road is built at an elevation much higher than the golf course. The drainage water has been traveling underground and surfacing in Fairway Drive and the parking lot. This agreement addresses the repair of the damaged infrastructure as well as the construction of a v -ditch and gutter along the eastern edge of Fairway Drive. WO November 28, 2000 Page 2 SUBJECT: AGREEMENT WITH WESTERN HILLS GOLF ASSOCIATION, LTD. FOR PARK LAND, ACCESS AND WATER LINE EASEMENTS, ACCEPTANCE OF FAIRWAY DRIVE INTO THE CITY MAINTAINED STREET SYSTEM, DRAINAGE AND STREET IMPROVEMENTS ON FAIRWAY DRIVE, AND PARKING LOT IMPROVEMENTS A state grant amounting to $295,500 was awarded to the City in the 1999/2000 fiscal year for the establishment of a park in the Carbon Canyon area. Land currently owned by WHGA has been identified for this purpose. The agreement includes conveyance by WHGA of the 1.5 -acre site to the City in exchange for the acceptance of Fairway Drive into the City -maintained street system. In order to bring the street up to current City standards, it will be necessary to construct, patch and slurry seal that portion of the road that is not included in the water - damaged area cited previously. The execution of this agreement will result in a true public/private partnership with the end result favorable for both entities. The City receives land for a park in an area where no park exists, as well as easements for both future required uses and current utilization. Additionally, the City will correct a liability incurred from an inadequate drainage design. Meanwhile, WHGA is relieved of the maintenance and liability of the street adjoining the entrance to the clubhouse parking lot. REVIEW BY OTHERS: This agenda item has been reviewed by the City Attorney and the Finance Director. FISCAL IMPACT: The agreement includes no exchange of monies; however, the park, road and drainage improvements are projects included in the current year Capital Improvement Program. The on- going maintenance costs for Fairway Drive are estimated at $7,200. The on-going maintenance costs of the park will depend on the amenities included in project.
