CM2018-036 PLNG COM ACTION RE AGENDA ITEM 5BCM2018-036 DATE: June 6, 2018 MEMORANDUM TO: Honorable Mayor and City Cou cil FROM: Konradt Bartlam, City Mana r RE: PLANNING COMMISSION ACTION REGARDING AGENDA ITEM 5B — CUSTOM HOME DESIGN REVIEW NO. 457 FOR 15619 PINTO WAY At their meeting on June 5, 2018, the Planning Commission (Commission) received a report from City staff regarding the above-mentioned item, a request for approval of Custom Home Design Review No. 457 for the construction of a one-story, single-family detached residence consisting of 3,839 square feet of livable space with an attached 743 -square foot, three -car garage on the property located at 15619 Pinto Way. The Commission discussed a letter from an adjacent resident with concerns regarding the use of the property for commercial uses and the parking of commercial vehicles on the site. Staff responded that as the project is located in the RS zone, commercial uses are not permitted, and any use of the property in terms of a home occupation or the parking of a commercial vehicle would be regulated by the Development and Health and Safety Code sections of the Chino Hills Municipal Code. The Commission raised a concern about the driveway potentially being widened for the storage of vehicles. Staff responded that residential properties are required to be in compliance with the impervious surface development standards at all times, and proposed to add a condition specifically stating that the subject site must be in compliance with the impervious surface development standards at all times. The Commission had questions about potential sidewalk and gutter improvements at the proposed site. Staff responded that the Engineering Division had indicated that no proposed sidewalk and gutter improvements were planned on Pinto Way at this time. There were no further comments from the public concerning this project. The Commission indicated that they supported the design of the project, feeling it was a good improvement to the area and approved the project by a unanimous vote, 5-0. KB:JL:AL
