DATE: April 4, 2018 <br />MEMORANDUM <br />CM2018-021 <br />TO: Honorable Mayor and City Co I <br />FROM: Konradt Bartlam, City Man g <br />RE: PLANNING COMMISSION ACTION REGARDING AGENDA ITEM 6A — <br />STRUCTURES AND USES ON SINGLE-FAMILY RESIDENTIAL LOTS <br />At their meeting on April 3, 2018, the Planning Commission (Commission) conducted a <br />public workshop to discuss a Municipal Code (Code) amendment to allow for structures <br />and uses on single-family zoned properties without the requirement for a primary <br />dwelling unit. Currently, the Municipal Code identifies "single-family dwelling unit" as the <br />primary permitted structure in single-family zoning districts, and permits accessory uses <br />only when a single-family house is on the site. This workshop followed a January 9, <br />2018, request by the City Council to consider the proposed amendment, and a February <br />6, 2018, subsequent Commission workshop during which the Commission directed staff <br />to proceed with a Code amendment that would allow certain accessory uses on a single- <br />family residentially zoned site without the requirement for a house to also be on the lot. <br />During the April 3 workshop, the Commission considered staff recommendations and <br />agreed that accessory uses should be permitted on a vacant residential lot subject to the <br />following provisions: <br />• Because a primary rationale for the proposed Code amendment is to enable a <br />homeowner to expand their useable lot, the accessory lot should be located within <br />the Canon Lane, Sleepy Hollow or Carbon Canyon tracts of the Small Lot Overlay <br />Zone. <br />• The vacant residential lot ("accessory lot") should be located no further than 50 <br />feet from the "primary lot." The "primary lot" is the property which is owned and <br />occupied by the owner of the accessory lot. <br />• Uses permitted on the accessory lot should be limited to passive recreational or <br />horticultural uses. <br />• No electrical or mechanical equipment should be permitted on the accessory lot. <br />• No grading or paving should be permitted on the accessory lot. <br />• No sheds over four (4) feet in height should be permitted on the accessory lot. <br />
