02-13-2018 CC Rpt 22COUNCIL AGENDA STAFF REPORTCOUNCIL AGENDA STAFF REPORT TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS DATE: FEBRUARY 13, 2018 FROM: CITY MANAGER ITEM NO:22 SUBJECT:RESOLUTION ORDERING THE ENGINEER'S REPORT FOR SPECIAL MAINTENANCE AREAS 1 AND 2 RECOMMENDATION: Adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, INITIATING PROCEEDINGS AND ORDERING THE PREPARATION OF THE FISCAL YEAR 2018/19 ENGINEER'S REPORT FOR THE CHINO HILLS SPECIAL MAINTENANCE AREAS 1 AND 2 BACKGROUND/ANALYSIS: The Chino Hills Special Maintenance Area No. 1 was authorized to provide street sweeping services throughout Chino Hills and to levy a special service charge to cover the costs of furnishing that service. Chino Hills Special Maintenance Area No. 2 was formed to provide road maintenance in the Sleepy Hollow area and was also empowered to levy a special service charge to pay for that benefit. Adoption of the above referenced resolution initiates the annual proceedings and directs the preparation of the required Engineer's Report detailing the cost of operation for street sweeping and road maintenance services, and the recommended distribution of assessments. The proposed report, once it has been completed, will be presented to the City Council on May 22, 2018, and a public hearing date will be set for final approval. ENVIRONMENTAL (CEQA) REVIEW: This action is not a project within the meaning of the California Environmental Quality Act (California Public Resources Code § 2100, et seq., "CEQA") and CEQA Guidelines (Title 14 California Code of Regulations § 15000, et seq.) Section 15378 and is therefore exempt from CEQA. Respectfully Submitted,Recommended By: Attachments Resolution 104/231 1 of 3 RESOLUTION NO. 2018R- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, INITIATING PROCEEDINGS AND ORDERING THE PREPARATION OF THE FISCAL YEAR 2018/19 ENGINEER’S REPORT FOR THE CHINO HILLS SPECIAL MAINTENANCE AREAS 1 AND 2 WHEREAS, Chino Hills Special Maintenance Area 1, previously formed by the Board of Supervisors of the County of San Bernardino as County Service Area 70-CH, provides street sweeping services throughout Chino Hills; and WHEREAS, the Chino Hills Special Maintenance Area 2, previously formed by the Board of Supervisors of the County of San Bernardino as County Service Area 48- A, provides road maintenance services in the Sleepy Hollow area of Chino Hills; and WHEREAS, City Ordinance #92-02 adopted, among other San Bernardino County Ordinances, #SD 91-11 and #83-2, which provide for the computation, levy, and collection of special service charges for the above named services; and WHEREAS, condition #9 to the City’s incorporation orders that all special taxes, assessments, fees, and charges established by the County of San Bernardino for the Chino Hills area shall be continued by the City of Chino Hills, as a successor local agency. NOW THEREFORE, the City Council of the City of Chino Hills, does hereby resolve, determine, find, and order as follows: SECTION 1. The City staff is directed to prepare and file with the City Clerk an Engineer’s Report in accordance with Ordinance No. SD-91-11 and all other applicable law. SECTION 2. That it is in the public interest and it is the intention of the City Council to order that the expenses necessary for the maintenance, repairs, replacement, utilities, care, supervision, and all other items necessary for proper maintenance and operation of the improvements shall be confirmed as a special service charge upon each lot or parcel of land lying within the maintenance areas in proportion to the estimated benefits received from the existing improvement. SECTION 3. On May 22, 2018 the proposed report will be presented to the City Council at the Council Chambers of the City Hall, 14000 City Center Drive, Chino Hills, California 91709, at which time a fixed time and place will be determined by the City Council when and where any and all persons having any objections to the confirmation of the charges or annexations for fiscal year 2018/19, may appear before the City Council to protest such confirmation or annexation. 105/231 2 of 3 SECTION 4.
