02-13-2018 CC Rpt 20COUNCIL AGENDA STAFF REPORTCOUNCIL AGENDA STAFF REPORT TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS DATE: FEBRUARY 13, 2018 FROM: CITY MANAGER ITEM NO:20 SUBJECT:RESOLUTION ORDERING THE ENGINEER'S REPORT FOR CHINO HILLS LANDSCAPE AND LIGHTING DISTRICT NO. 1 RECOMMENDATION: Adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF THE CHINO HILLS LANDSCAPE AND LIGHTING DISTRICT NO. 1, PURSUANT TO PROVISIONS OF LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ., STATE OF CALIFORNIA) ORDERING THE PREPARATION OF THE FISCAL YEAR 2018/19 ENGINEER'S REPORT. BACKGROUND/ANALYSIS: The Chino Hills Landscape and Lighting Districts Nos. 1 and 2 were formed to provide funding for the maintenance of street lighting, park, open space, and landscaping maintenance, as well as improvements throughout the districts. On July 28, 1992, the City Council accepted the consolidation of the two districts into a single district. Annually, the City Council is required to conduct a public hearing to review the operational cost for the Landscape and Lighting District (District) as presented in the Engineer's Report, and to set the annual assessments on properties within the District. Approval of this item will allow the completion of the Engineer's Reports for the fiscal year 2018/19 to proceed. The proposed report, once it has been completed, will be presented to the City Council on May 22, 2018, and a public hearing date will be set for final approval. ENVIRONMENTAL (CEQA) REVIEW: This action is not a project within the meaning of the California Environmental Quality Act (California Public Resources Code § 2100, et seq., "CEQA") and CEQA Guidelines (Title 14 California Code of Regulations § 15000, et seq.) Section 15378 and is therefore exempt from CEQA. Respectfully Submitted,Recommended By: Attachments Resolution 94/231 1 of 3 RESOLUTION NO. 2018R- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF THE CHINO HILLS LANDSCAPE AND LIGHTING DISTRICT NO. 1, PURSUANT TO PROVISIONS OF LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ., STATE OF CALIFORNIA) ORDERING THE PREPARATION OF THE FISCAL YEAR 2018/19 ENGINEER’S REPORT WHEREAS, Chino Hills Landscape and Lighting District No. 1 (District) has been duly formed to generally include the Chino Hills Specific Plan Area; and WHEREAS, Chino Hills Landscape and Lighting District No. 2 was consolidated with Chino Hills Landscape and Lighting District No. 1; and WHEREAS, the consolidated District was established to provide street lighting, open space, park, landscaping, fencing, irrigation maintenance, improvements, and other similar appurtenances; and WHEREAS, the Landscaping and Lighting Act of 1972, Streets and Highways Code, Section 22500 et seq., provides for the annual preparation of an Engineer’s Report and the confirmation and levy of assessments upon the parcels within the District(s) for the estimated expenditures to provide services. NOW THEREFORE, the City Council of the City of Chino Hills, acting in its capacity as the governing body of Chino Hills Landscape and Lighting District No. 1, does hereby resolve, determine, find, and order as follows: SECTION 1. The City staff is directed to prepare and file with the City Clerk an Engineer’s Report in accordance with Article 4 (commencing with Section 22565) of Chapter 1 of Part 2 of Division 15 of the Streets and Highways Code of the State of California. SECTION 2. The improvements to the District shall include, in addition to any improvements previously authorized by the District, street lighting, landscaping, open space, park, and irrigation maintenance, the addition of new capital facilities of similar nature, and any appurtenances thereto. SECTION 3. On May 22, 2018 the proposed report will be presented to the City Council at the Council Chambers of the City Hall, 14000 City Center Drive, Chino Hills, California 91709, at which time a fixed time and place will be determined by the City Council when and where any and all persons having any objections to the confirmation 95/231 2 of 3 of the charges or annexations for fiscal year 2018/19, may appear before the City Council to protest such confirmation or annexation.
